I understand that I am required to pay the full amount (please refer to the online store order). Once I have paid this amount after signing this contract, I am committing to my spot. In the event that I wish to cancel, all my retainer will be non-refundable. If I choose a higher package, I am not able to downgrade. Only upgrades are allowed. In the event of not being available for my session, I am required to give Winnie Bruce Photography at least 4 hours notice prior to mini-session event. The retainer can be transferred to a full-session at a different date.

All payments can be made through credit cards (Mastercard, Visa, Discover), Paypal, cash or check. In the event the payment is made by check, and the check doesn’t clear, there’s a $25.00 return fee.

I have purchased a spot for a 20 minute session with 5 digital image for $250.00. This allows me a gallery with print release for the 5 images for 5 people or lower. If my session has more than 5 people, I am required to pay an additional fee.

For full release to Winnie Bruce Photography Photography for the use of your photos, please select to agree to the following statement. *

I hereby grant Winnie Bruce Photography the right to use all digital negatives and/or reproductions from my photo session for display, publication, related website and blog use, contest entry, and/or peer review. I understand that although I have personal use rights to print and share the images which result from my session in any way for my own use only, they remain the intellectual property of Winnie Bruce Photography.

Please read and accept the following statement. *

I understand that Winnie Bruce Photography owns the copyright to all of the edited images received from my session. I will be granted a print release for personal use of my images, however they may not be cropped, edited or altered in any way. Doing so is an infringement of US Copyright Law (USC Title 17), for which fines begin at $50,000.

Disclaimer *

If you would like to purchase additional products or prints, please visit our website. Prices are subject to change at any time without client notification. This contract solidifies the package contents and price at the time of booking. This contract is specifically for services and products purchased on purchase date.

Any addendums made to this contract, must be agreed upon by all parties involved, in writing.

Print Credit *

Print credit will be activated on the day that the session is turned over. The print credit will be active for 10 days. Expiration date will be on the bottom of the gallery. If the print credit is not claimed within those 10 days, the print credit will expire. Print credit will only apply to physical prints depending on what’s included in the package. Please see Purchased Package Contents/Price. Print credit does not apply to digital products, or The Organic Bloom Frames.

Retainer *

This signed contract and the retainer are required to book the portrait session and purchased package. The retainer deposit is the session fee. In the event of a canceled session this retainer deposit is non-refundable. The retainer fee covers all editing, email correspondence, and customer service given to client. Under no circumstance, (i.e. sickness, relocation, personal reasons) will the retainer be refunded.

Weather *

In the event that the weather conditions are not desirable for the shoot based on studio recommendations, the session will need to be rescheduled and the fee will be waived. Due to liability and equipment damages this decision will be at studio discretion. In the event that a reshoot has been scheduled due to the nature of the client appearance in the previous session, the client is held responsible for purchasing an additional package.

Editing and Image presentation *

Upon hiring Winnie Bruce Photography, client understands the style of photography and editing that Winnie Bruce Photography does. The creative session fee covers all editing. All images are processed with Winnie Bruce Photography signature post processing. Minor retouching such as skin smoothing, removal of unsightly items in the photograph, and adjusting colors are all to be done with photographer's personal discretion. Clients are allowed to ask for only ONE minor adjustment, such as head swaps, color tone change that does not stray from photographer's style, or anything that can be quickly fixed with the spot heal, or clone tool in photoshop. Any requests for re-editing after the first re-editing will be charged an additional fee. Re-editing fees start at $25.00 depending on client requests.

Image Presentation *

Client acknowledges that by purchasing digital goods, that they are knowledgeable in regards of how to handle the files. Files are turned over in full-resolution JPEG files. The files come with a print release, and recommended to be printed through Winnie Bruce Photography’s chosen labs. If client chooses to print through any labs other than through the photographer, Winnie Bruce Photography cannot be held responsible for how the prints turn out. Winnie Bruce Photography holds no responsibility or does not aid in assistance in handling the files, such as files being too large, too small, or not the correct color if not printed through Winnie Bruce Photography. Client agrees that by purchasing high resolution files, that they have proper knowledge on how to treat, save, download, and backup said files.

Gallery *

Included in my session fee is a gallery to be hosted for 10 days. I understand that I must place my print order using my print credit within those 10 days. Once the gallery expires, Gallery reactivation is $50.00

Cancelation *

Cancelation: In the event the client would want to cancel their session, all deposits will not be returned. If the session is canceled in less than 24 hours, there is a $50.00 cancelation fee. Canceled sessions can be transferred to a full session within 6 months of Mini-session date with the addition of the cancelation fee.

Limit of Liability *

In the unlikely event that the photographer is injured or becomes too ill to photograph the session, studio will make every effort to secure a replacement photographer unless otherwise specified by the client. If the situation should occur and a suitable replacement is not found or accepted, a reshoot will be scheduled for the next available time slot. In the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond studio control, studio liability is limited to the return of all payments received for the portrait session. The limit of liability for a partial loss of originals will be a prorated amount of the exposures lost based on the percentage of total number of originals.

Schedule Arrangements *

Due to the nature of the session a strict timeline will be enforced to ensure the package obligations are met. The session will start at the scheduled start time even if the client is tardy or unprepared. The session end time will remain the same. If additional time is needed, client will have the option to purchase based off the a la carte pricing menu for additional time. If you have more than one location for your session, the travel time going from destination A to destination B so forth does count towards the total amount of the session time. The same applies for outfit changes; changing from one outfit to another does count towards the total amount of the session time. The client is responsible for providing any props or outfits that are to be used within the session. Winnie Bruce Photography will not be held responsible for additional sessions needed due to forgotten items.

Completion *

Due to the nature of these sessions, completion and product delivery time may vary. Please refer to the product/print order contract for specific completion times and dates for your purchased products.Average completeion time is 14-18 business days. If your session falls on a weekend, your session will be delivered on a weekday. If client would like the images to be completed sooner than the regular turnaround time, there is a rush charge of $100.00 to complete the images before the regular turnaround time.

Cooperation *

Winnie Bruce Photography is not held responsible for behavior of parties involved with the shoot, with the exception of studio personnel. If the desired outcome of your session is jeopardized by the behaviors of parties involved with the exception of studio personnel, studio cannot be held responsible.

Coupons / Promotions / Discounts

Winnie Bruce Photography does not offer any discounts or coupons for mini-sessions unless otherwise specified and a coupon code is provided. Military discount does not apply to mini-sessions. In the event a coupon or sale is purchased, the discount will only apply to the initial session fee + package combination originally purchased. If a client decides to upgrade later after the session is received, the upgrade price will be at the regular rate. Sales cannot be combined with other discounts. The larger discount will be honored first.
