  • Cognitive functioning is at least three (3) standard deviations below the mean; 

  • AND,

    Adaptive behavior deficits are at least three (3) standard deviations below the mean;

  • AND,

    A severe deficit exists in overall academic performance, including acquisition, retention, and application of knowledge;

  • AND,

    The mental disability was manifested between birth and age twenty-one.

  • Deficits have an adverse effect on educational performance.

  • Lack of instruction in reading and/or math was not a determinant factor in the 

    eligibility decision.

  • Limited English proficiency was not a determinant factor in the eligibility decision.

  • The child is eligible for specially designed instruction and related services.

  • The parent was provided a copy of the evaluation report AND documentation of eligibility is given to the parent(s). 

    OR

    If parent did not attend the ARC, then a copy of the evaluation report and documentation of eligibility were sent 

    home to the parent.
