    The ARC documented the existence of one or more of the following: 

  • limited strength,

  • OR, 

    Vitality,

  • OR,  

    alertness, including a heightened alertness to environmental stimuli, 

    resulting in limited alertness with respect to the educational environment.   

  • The condition is due to a chronic or acute health problem (e.g., acquired 

    immune deficiency syndrome, asthma, attention deficit disorder or attention deficit

    hyperactivity disorder, diabetes, epilepsy, heart condition, hemophilia, lead poisoning, 

    leukemia, nephritis, rheumatic fever, sickle cell anemia, Tourettes Syndrome, or

    tuberculosis).

  • Deficits have an adverse effect on educational performance.

  • Lack of instruction in reading and/or math was not a determinant factor in the 

    eligibility decision.

  • Limited English proficiency was not a determinant factor in the eligibility decision.

  • The child is eligible for specially designed instruction and related services.

  • The parent was provided a copy of the evaluation report AND documentation of eligibility is given to the parent(s). 

    OR

    If parent did not attend the ARC, then a copy of the evaluation report and documentation of eligibility were sent 

    home to the parent.
