A. Session Fees

Client agrees to pay photographer session/package fee total $250 for 2 hours coverage for 7/3/2026.

Dates/times are not reserved or held until payment or deposit (50% deposit). Remaining balance (if applicable)due in full on day of session.

 

B. Location Costs & Fees

If there are any costs/fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees. The photographer will not guarantee or arrange payment on any location. Session fee covers travel within 60 minutes of 89147. Any location outside of these limits will be subject to an additional charge of $25.00

C. Rescheduling

If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 3 days prior to their shoot, based on availability, without penalty. Session fees and deposits are nonrefundable in the event of a cancellation by the client, but may be transferred to a future session. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.

D. Re-shoots

Re-shoots are determined at the discretion of the photographer. Re-shoots will not be given for poor choices of clothing, make-up, hair or weather related issues, cooperation of participants, or by not following the recommendations of the photographer.

E. Archive

Images purchased by the client will be archived for 6 months. Images not purchased will be immediately purged. After six (6) months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.

F. Payment

All payments are due in full unless payment arrangements have been made. Upon receipt of payment, session date and time will be reserved for client. Session dates and times are not reserved until payment is received and will still be available for bookings until confirmed payment. Orders will not be processed until payment in full is received. If client has arranged a payment plan, final payment must be made the day prior to scheduled session. Print or product orders will be placed after the final payment has been received.

G. Damage

Photographer is not responsible for the damage of portraits after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits upon receipt.

H. Capture and Delivery

Michelle Clark photography is not liable to deliver every image taken at the event. The determination of images delivered to the client is left to the discretion of the Michelle Clark Photography.

I. Post Production and Editing

The final post production and editing styles, effects, and overall look of the images are left to the discretion of the Michelle Clark Photography. Additional editing available for an extra charge per image for requests to fix/change something beyond photographer's control. Including but not limited to, hair or wardrobe fixes, color changes, skin retouching, body sculpting, face swaps etc. Not all editing requests will be able to be accomodated. Final images delivery 2-6 weeks depending on time of year/volume. 

J. Model Release

I hereby give to Michelle Clark Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others:

a) To copyright the same in the photographer’s name or any other name that he/she may select;

b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and;

I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.

K. Liability

Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.

L. Copyright & Penalty

Michelle Clark Photography ( the "Photographer" ) owns all right and title to the copyrights in all images and photographic materials created on behalf of the Client and shall have the exclusive right to make prints or reproductions. Photographer reserves and the Client expressly grants the express right of Photographer to make reproductions and use the photographs and images of Client and/or Client's minor children listed above for use in connection with Photographer's portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, advertising and promotion, books, magazines, illustrations, editorial use, or for display within or on the outside of the Photographer's studio, on Photographer's website, including on all printed materials, media on the Internet, and any current or future digital media. Photographer reserves the right to sell and distribute such material uppon written notice to Client at the address listed above. Nothing herein shall be deemed as a release transfer assignment or other disposal of Photographer's right in the material.  A print release is included with digital files to print portraits for personal use up to designated size listed on print release. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Michelle Clark Photography during client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. 

M. Session Requests

*No cameras/camcorders/any type of recording device (this includes cell phone cameras) are allowed during the session unless approved by photographer. Please ask before taking any "behind the scenes" photos or videos.

Notes from your photographer-

Session starts at the agreed upon time. Photographer will notify client if any changes need to be made with aqequte notice. If any changes need to be made on client's behalf, please contact the photographer with adequate notice. I know life happens sometimes, and I do my best to make sure to accomodate as much as possible!

I work very hard to create images that reflect you and your family, while keeping in line with my artistic vision and creativity. I know you will want to share them and include a sneak-peek for that very reason. However, I ask that you simply link back to my blog/website/facebook page instead of right-clicking, saving, and sharing the image via your own page. I hope that you will respect not only my hard work, but the time, money, and dedication that I have put into training and equipment to capture these images for you. Please do not screenshot "proofs" as that is considered stealing. Please do not edit or add filters to your images as that does not represent the work of the photographer authentically.
