PLEASE READ BEFORE SIGNING
This is a binding legal document. The purpose of this document is to exempt, waive and forever relieve Brother Peter Paul, New Horizons Personal Management SFO, LLC, his agents, assigns and principals, from any and all liability for personal injury, either physical or emotional, sexual, property damage, wrongful death, or any other claim that may result from my being a participant in any of the counsel or activities offered by Brother Peter Paul Life Coach, Spiritual Director, Facilitator and/or limited financial consulting, New Horizons Personal Management SFO LLC or related to my receipt of spiritual direction by him or his participation as a facilitator. I understand and acknowledge that all sessions will be recorded by video and or audio or any other current recording technology. I acknowledge the receipt for valuable consideration in exchange for my signing this agreement. If you have questions regarding your legal rights, you should first seek legal counsel prior to signing. I affirm that I am financially able to afford such legal counsel regarding this document.
By signing this agreement, I acknowledge that I have retained Brother Peter Paul, New Horizons Personal Management SFO LLC to act in the capacity as a non-licensed Life Coach, Spiritual Director, Facilitator and/or limited financial consulting for me, my child, or legal ward, where by he may advise me and facilitate on my behalf or my child’s behalf in that limited capacity for which Brother Peter Paul, New Horizons Personal Management SFO LLC is forever released by me of any liability that may be incurred. I recognize and admit that Brother Peter Paul, New Horizons Personal Management SFO LLC is not a licensed medical doctor, psychologist, therapist, psychotherapist, nurse, licensed counselor or social worker in this or any other state and has not held himself out to be acting in or possessing those professional skills.
In consideration of retaining Brother Peter Paul, New Horizons Personal Management, LLC to act as a non-licensed life coach, spiritual director, facilitator and/or limited financial consulting for myself or my child, I agree to voluntarily elect to participate such activities, and I, as Participant (and as parent(s) or guardians(s) of a Participant who is a minor, if applicable), covenant and agree as follows:
1. RULES, TERMS AND CONDITIONS OF PARTICIPATION. I have read and understand the Disclosure Statement (and have explained them to my minor Participant, (if applicable) and will comply with all rules and conditions of participation that Brother Peter Paul, New Horizons Personal Management SFO LLC determines to be necessary at all times. Brother Peter Paul, New Horizons Personal Management SFO LLC, in his sole discretion, may terminate his services and my participation at any time without incurring liability if I fail to abide by his rules, conditions and terms.
2. RELEASE AND DISCHARGE. I (and as parent(s) or guardian(s) of a Participant who is a minor or legal ward, if applicable), hereby release, discharge and hold harmless Brother Peter Paul, New Horizons Personal Management SFO LLC, his agents and principals, from and against any and all claims, liability and/or causes of actions I, or my child or ward, may have or that may be made on my behalf or by my spouse, former spouse, children, heirs and legal representatives, for emotional or bodily injury or personal injury (whether physical, sexual, emotional and/or psychiatric or any combination thereof), heart attack, stroke, death, wrongful death, loss of consortium, property damage, and/or breach of contract or any other damage or other ailments that could cause serious disability, occasioned by, arising out of, or incidental to my participation in the activities of receiving limited financial consulting, Life Coaching, Spiritual Direction and/or Facilitation of such. I state that I am competent to sign this release and waive any challenged to this agreement based on lack of capacity, competency or mental disability on my behalf.
3. INDEMNITY. I shall defend, indemnify and hold harmless Brother Peter Paul, New Horizons Personal Management SFO LLC from any and all claims, actions suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my participation (or that of my minor participant, if applicable) and to reimburse them for any such expenses incurred. I agree that this agreement may be pled as a defense to any action, suit or proceedings taken at any time against Brother Peter Paul, New Horizons Personal Management SFO LLC, his agents and principals by me (or on behalf of my minor Participant, if applicable), and may be filed as evidence or as an exhibit before the court.
4. SEVERABILITY. I (and as parent(s) or guardian(s) of a Participant who is a minor or legal ward, if applicable), further expressly agree that the foregoing waiver, assumption of risks, release and indemnity agreement is intended to be as broad and inclusive as is permitted by the laws in the State of Nevada and if any portion thereof is held invalid, it is agreed that balance shall, notwithstanding, continue in full force and effect.
5. BINDING ON SUCCESSORS. This agreement binds the heirs, administrators, executors, personal representatives, dependants (if any), and successors of the Participant and ensures the benefits of Brother Peter Paul, New Horizons Personal Management SFO LLC and his successors and assigns. In addition, any fees or costs billed to the client and remaining unpaid for thirty (30) days shall be cause for termination of this agreement by the firm and commencement of legal proceedings to collect the same. In the event such collection procedures become necessary, client agrees to pay the firm all reasonable costs of such collection including, but not limited to, reasonable attorney’s fees, and hereby consents to the jurisdiction of Washoe County, Nevada.
6. SIGNATURES. I HAVE READ AND DO VOLUNTARILY SIGN THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISKS, RELEASE AND INDEMNITY AGREEMENT, and further state and agree that no oral representations, warranties, statements or inducement apart from the foregoing written agreement have been made.
