Terms & Conditions
1. Session Fees
Client agrees to pay photographer a retainer of $100 at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee that goes toward your session. If there is a balance it is due at the time of the session. The session fee covers the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer. You can view your Portraits at www.connieperkinsphotography.com. Additional editing is available at additional expense to be determined by photographer. Additional prints or digital images may be available for purchase.
2. Location Costs & Fees
If there are any costs/fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees. The photographer will not guarantee or arrange payment on any location. Creative fee covers travel within 30 minutes of Lumberton, TX. Any location outside of these limits will be subject to an additional charge of $.52/mile as part of the agreement.
3. Rescheduling/Cancellations
If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hours notice, or decide to completely cancel the shoot, this session fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.
4. Re-shoots / Refunds
Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair or weather related issues, or by not following the recommendations of the photographer.
5. Archive
After three (3) months, all ordered images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control. All photos not ordered will be deleted to make room.
6. Payment
All payments are due in full unless payment arrangements have been made. Orders will not be processed until payment in full is received. If client has arranged a payment plan, order will be placed after the final payment has been received.
7. Damage
Photographer is not responsible for the damage of portraits after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits upon receipt.
8. NO ELETRONIC DEVICES
Cameras, cell phone cameras, and camcorders are not permitted during sessions.
9.Digital Images.
If the client purchases the digital download of images, Perkins Photography will provide detailed printing instructions. To ensure the best print quality, avioid altering the images before printing. The photographer is not responsible for printing errors or for quality of prints or products printed eleswhere.
10. Returned Checks
Checks returned by the bank, for any reason, will be charged a $25.00 service charge. and session/orders will be cancelled if they are not paind in full within three days of notification.
11.Copyright Laws/Model Release. Perkins Photography retains the copyright on all images (even those purchased on a CD) and reserves the right to use the images for advertising, display, publication, or other purposes. The client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons includied in the portrait in this manner and shell indemnify property of this Studio/Photographer. Under no circumstances, can a client use these images for profit, commercial endeavors, professional display, or in competitions. Copying or scanning images from the client's gallery, Perkins Photography's website or blog is considered stealing, regardless of the intent for use. NOTICE OF COPYRIGHT: It is ILLEGAL to redistribute these photographs for profit or use other than private consumption without the photographer's permission, and violators of this Federal Law will be subject to its civil and criminal penalties.
12.Liabiltiy.
Client is aware that the quality of the end result print of the digital files delivered is not under the control of the photographer and frees the photographer from any liablitiy for any claims whatsoever based upon discoloration in the end result print.
If the photographer cannot fullfill this Contract due to fire or other casuality, strick, act of God, or other cause beyond the control of the parties, or due to the Photographer's illness or emergcy, then the photographer shall return any deposit or sitting fee to the Cllient but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing. lost through camera or malfunction, lost in the mail, or otherwise lost or damaged withut fault on the part of the photographer. In the event the photographer fails to perform for any other reason, the photographer shall not be liable for any amount n excess of the retail value of the client's order. The client releases Connie Perkins, from all liabilities, clains and damages that may result from any accidents or incidents that may happen during the session.
All images are copyright under the Federal Copyright Laws and subject to fines of up to $150,000 if breaking those laws. By signing this contract you agreeing not to copy, save, or reproduce images in any way. This includes copying and saving images from the website, blog, Facebook, or any other form of advertisment.
