I, the  undersigned (Name printed above) (Participant) wish to participate in the BodySTARR LLC Group Fitness, Tae Bo® Fitness Classes, other fitness classes and/or Personal Training sessions.

I acknowledge and agree that participation in the BodySTARR LLC Group Fitness Classes, Tae Bo® Fitness Classes, other fitness classes and/or Personal Training sessions, includes engaging in high intensity workouts (hereinafter "Activities").  I understand and acknowledge that the Activities may be dangerous and hazardous and, by their very nature pose the potential risk of severe and serious physical and emotional injury/illness or even death, to all individuals who participate in such Activities.

I understand, acknowledge and agree that in order to participate in the BodySTARR LLC Group Fitness Classes, Tae Bo® Fitness Classes, other fitness classes, and/or Personal Training sessions. I ASSUME ALL LIABILITY AND RESPONSIBILITY for any and all potential risks, injuries or even death which may be associated with participation in the BodySTARR LLC Group Fitness Classes, Tae Bo® Fitness Classes, and/or Personal Training sessions and the Activities.

I represent and warrant that I am mentally and physically fit, capable, able, and willing to participate in the BodySTARR LLC Group Fitness Classes, Tae Bo® Fitness Classes, other fitness classes, and/or Personal Training sessions and the Activities without any limitations.

I understand, acknowledge and agree that BodySTARR LLC., Stacey R. Long, and their partners, affiliated companies and entities, subsidiaries, agents, representatives, successors, predecessors, assigns, directors, officers, employees, shareholders, heirs, beneficiaries, spouses and attorneys, Tae Bo® Nation, Celebrity Sweat, Lindy Properties (collectively the "BodySTARR LLC Parties") shall not be liable for any injury or illness suffered by Participant which is incident to and/or associated with preparing for and/or participating in the BodySTARR LLC Fitness Classes, Tae Bo® Fitness Classes, and/or Personal Training sessions.

I hereby release, discharge, indemnify, and agree to hold harmless the BodySTARR LLC. Tae Bo® Nation, Celebrity Sweat, Lindy Properties, free from any and all liability arising out of, or in connection with, my participation in the BodySTARR LLC Group Fitness Classes, Tae Bo® Fitness Classes, and/or Personal Training sessions and the Activities, including all related activities. For purpose of this RELEASE, liability means all claims, demands, losses, causes of action, suits, or judgments of any kind that Participant or Participant’s heirs, beneficiaries, spouses, employees and attorneys may have against the BodySTARR LLC. because of Participant’s personal, physical or emotional injury, accident, illness or death, or because of any loss of or damage to property that occurs to Participant or his/her property during Participant’s participation in the BodySTARR LLC Group Fitness Classes, Tae Bo® Fitness Classes, and/or Personal Training sessions, and the Activities that may result from any cause, including, but not limited to, the BodySTARR LLC Parties’ own passive or active negligence or other acts other than fraud, willful misconduct or violation of the law.

I acknowledge that I have carefully read this VOLUNTARY PARTICIPATION FORM and that I understand the potential dangers incident to engaging in the  BodySTARR LLC Group Fitness Classes, Tae Bo® Fitness Classes, and/or Personal Training sessions, am fully aware of the legal consequences of this agreement and agree to its terms and understand that I am waiving certain rights and assuming the risk of damage from my participation in the Workout and the Activities.

I understand, acknowledge and agree that during my participation in the BodySTARR LLC Group Fitness Classes, Tae Bo® Fitness Classes, and/or Personal Training sessions and the Activities, pictures, including video, may be taken of me with voice sound and may subsequently be used in the promotion of the BodySTARR LLC. by the BodySTARR LLC. Parties. I authorize the use of my name and pictures of me including any accompanying voice, to be exhibited, with or without advertising sponsorship, as still photographs, transparencies, motion pictures, television, video or similar media and hereby release the BodySTARR LLC. from any and all claims for the taking and use of the same.

This agreement is not an employment agreement, partnership or joint venture of the parties hereto and neither party is the agent for the other.

A signed  VOLUNTARY PARTICIPATION FORM must be on file with BodySTARR LLC. before a Participant will be allowed to participate in the Group Fitness and or Personal Training Workouts.  Please Sign, Initial and print a copy for the records.

INDIVIDUALS WHO DO NOT WISH TO ACCEPT THE RISKS DESCRIBED IN THIS AGREEMENT SHOULD NOT SIGN THIS AGREEMENT, AND WILL NOT BE ALLOWED TO PARTICIPATE.
