    ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT (“AGREEMENT”)

  • I hereby authorize GYMNASTICS USA to pick up my child from his or her school on the pre-selected days I have (or will at a future time) signed up for. I understand that the assumption of risk and indemnity for transportation is consistent and understood to be equal with the "Activity Agreement" found below.  

    I further understand that in addition to this authorization, I am responsible for informing the appropriate school-officials and arranging the necessary paper work as is required by my child's school. I understand that if there is any important information that GYMNASTICS USA should know about my child, I will list it below as is necessary.

    Please be aware that in the event of vehicle issue and/or emergencies, your child may be picked up in a company-marked staff POV (Personally Owned Vehicle). We do not necessarily inform families each instance that this occurs, but vehicles are always marked and school officials are always aware.
  • No Pick Up Days:
  • I understand that is my responsibility to notify GYMNASTICS USA in advance if my child is not in need of pick up on a day she or he is pre-arranged for pick up.

    I also understand that Gymnatics USA utilizes the local county school calendar to which it is located. All "no-school days" found within that calendar are days that Gymnastics USA's after school program is closed. Most "no-school days" Gymnastics USA offers a day camp available for an additional cost. On "no-school days" that Gymnastics USA is open, After School students are welcomed to come for their daily recreational classes. 

    Important Note About Make Ups: Days & times follow the Orange County Public School operating calendar. If OCPS is out, the After School program is closed. We do offer make-ups for the recreational class your After School students will miss that day. However, we do not offer make up days for the After School Program. If you are seeking a make up class for missed After School days, it will not include pick-up or any portion of the After School program: only the recreational class portion is included.

    Assumption of Risk and Indemnity
    Gymnastics and all of its auxiliary and offspring programs are relatively safe activities, especially when considering the safety measures, professional equipment, and high-level training GYMNASTICS USA utilizes and partakes in. Yet, any time an activity involves height and momentum, there is a risk of minor to severe injury. In order to make our program as safe as possible all of our staff members are required to go through our proprietary training courses which include our propitiatory Basic First Response & CPR Certificate program. The course not only trains our instructors in First-Aid but also, through our coaching certificate courses, we create scenarios of potential risk, which instills a safety conscious philosophy that is applied to our methods of instruction.  

    In consideration of participating in GYMNASTICS USA, I represent that I understand the nature of this Activity and I hereby for myself, my children, my heirs and executors vow that if any of the aforementioned should partake in physical activity at GYMNASTICS USA, the same shall be qualified, in good health, and in proper physical condition to participate in such Activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participation in the Activity. I fully understand that this, similar to all other sports and activities, involves risks of bodily injury, including permanent injury, which may be caused by my own actions, or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the “Releasees” named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, cost, and damages I incur as a result of my participation in the Activity.  

    I further acknowledge, understand, appreciate and agree that my participation may result in possible exposure to and illness from infectious diseases, including, but not limited to, MRSA, Influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others, and assume full responsibility for my participation and exposure.

    I hereby release, discharge, and covenant not to sue GYMNASTICS USA, its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the “RELEASEES” herein) from all liability, claims, demands, losses, or damages, on my account caused or alleged to be caused in whole or in part by the negligence of the “Releasees” or otherwise, including negligent rescue operations and future agree that if, despite this release, waiver of liability, and assumption of risk, I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any loss, liability, damage, or cost, which may incur as the result of such claim. Furthermore I hereby authorize GYMNASTICS USA to utilize any photography, video, or other likeness of myself for advertisement use, promotional use, training education, and/or any other reasonable purposes that GYMNASTICS USA may see fit. 
  • Drop Notice Requirement: 

     

    "Written Drop Notice" is required to become inactive with Gymnastics USA (inactive meaning that you will no longer be enrolled in any classes whatsoever). The notice must be received before the 1st day of the tuition cycle prior to the tuition cycle dropping. i.e. client expecting to drop classes prior to tuition cycle February 17, 2020, must give a drop notice by January 20, 2020. Please understand that dropping the program means your membership expires early! You will lose all rights to any remaining make-up classes... these will not be renewable and are non-transferable.

  • Recreational Classes:
     
  • I understand that it is at the full discretion of Gymnastics USA staff to make recreational class scheduling decisions. I realize that my child will participate in a recreational class each day but that the schedule and time for the class may change based on After School scheduling needs. If I have special requests relating to recreational classes I understand that I need to speak with mgmt. Requests cannot always be fulfilled and are based on current availability.

I understand that I am signing this document regarding my child who is named below and that all which is written above applies to this agreement with regard to my child and/or other children who I am signing for below.
