Your Creative Fee Includes:

 

• Pre-portrait consultation to bring forth ideas and input to ensure a successful session.
• Style Consult.
• Phone consult the day of your session.
• Unlimited Email Consults prior to session date.
• Up to 2 hours (30 min. for the mini session) of coverage on your session date.
• Post-session image preparation.
• In-Person Viewing Appointment.
• Your session fee does not include any prints or digital products.

 ** Some collections include Professional Hair & Make-up and some include an image credit. Please check your invoice verbiage to confirm if you have an image credit and how much it is and if a stylist is included or incurs a separate fee.**

Portrait Studio Policies

• I have read and received a copy, via electronic media, of your studio policies & liability release (full policies listed below). I agree to sign this legal document electronically through the Kelly King Photography Portrait Session Agreement.

 

Usage of Images

Kelly King, Principal Photographer is an artist and as such requests that the work she creates be allowed into art exhibits, displayed in her studio, print competitions, and other places where her work is featured regularly. The work is always showcased in the best possible way and will never compromise or jeopardize the photographer's hard-earned reputation. Confidentiality in advertising is always maintained.

I agree that I have read this portrait agreement and agree to comply with all policies and information included. I agree to sign this document via electronic signature and that by signing electronically, it serves as my actual hand-written signature on a legal document. I also agree that the photographer may use any images created during my commissioned session for display, advertisements, exhibits, sale or trade or other use as deemed appropriate by Kelly King. I agree these images can be used without any additional compensation to me. 

 

Creative Session Fee

• The creative/session fee covers the time and talent of the photographer, when appropriate a photographer's assistant, basic retouching and creative editing of images,  by the photographer in preparation for client viewing, at the presentation appointment.  Additional editing is available, cost to be determined by the photographer/editor. Prints, wall portraits, albums and other digital and print products are available for purchase separately. The creative fee pays for the time and talent of the photographer and for your in-person viewing appointment. It does not include any finished portraits. The creative fee is due at the time of booking your portrait session. Creative fees are non-refundable, however, with 48 hours' notice, it can be rescheduled in case of an emergency one time. 
• Image credits: If your session/creative fee includes a print/digital credit- the client may apply the credit towards any image purchase from the Kelly & King product line (including digitals). (Please check your invoice for a print credit amount, if any.)

 

Location Costs & Fees

• Costs or permit fees associated with the client's location choice... you, the client, a responsible for additional fees and securing any required permits (we are more than happy to assist you in this endeavor if needed.) The photographer does not guarantee, nor arrange payment on any location. The session/creative fee covers travel within 20 miles of League City, TX.   Any location outside of this radius may be subject to an additional travel charge.

Sick Ones

• If anyone being photographed is sick on the day of the session or has run a fever in the last 36hrs please call to reschedule. If you try to keep the appointment, we will request that you reschedule if we notice that you, your child, or anyone in your session is sick. Sick or uncomfortable adults and children do not like to be photographed and we know that you will not love your portraits nearly as much as if everyone was in good health. In addition, we photograph newborn babies and elderly clients and will not knowingly expose these vulnerable populations to illnesses that could result in health complications.

 

 Who Can Attend a Session?

• Only the persons or pets being photographed. This is especially important with pets and kids, as your photographer needs their full attention on the photographer. Of course, parents are always welcome! 

 Recording Personal Photos or Video

• Personal cameras are not allowed in studio or on location during your session. Please refrain from taking I-pad images, cell phone photos or videotaping, and leave all recording devices concealed (in a purse, backpack, or vehicle). 

 Liability Release

• You agree to hold harmless, Kelly King, her representatives, employees and Kelly King Photography also known as Kelly & King Photography, from any dispute in the event you or your family become injured during your session or while at any location. Kelly King Photography and its representatives will not be held liable for any injury to you, your children or your family members, or for any damage, loss or theft to your property during the photo session or while on location or studio premises. Please note that many of our location shoots are outdoors, in nature, and there are many potential hazards including; wild animals, insects, trip and fall hazards, etc. To book a session with Kelly King Photography aka Kelly & King Photography the client acknowledges there are hazards associated with location photography, props, and studio sets and assumes any responsibility for the client's own safety.

 Client Viewing Appointment

• You will view your portraits at a personally attended slideshow. Clients are asked to order at this time. Please make sure all decision-makers are present, as additional ordering appointments incur a $100 fee. Once your order is placed in person, your ordered digital images will be uploaded to an online gallery. Images are hosted in your Kelly & King Photography online gallery for a period of one year.  Anyone with whom you choose to share the gallery can view and share social media-sized images. We do not control access, however, upon the client's request, we can password-protect an online gallery. It is the responsibility of the client to distribute their password. 

 Which Images Will I View?

• While your photographer captures many images during your session, you see only those images selected by the photographer for previewing. Each image is carefully rendered to ensure maximum artistry and technical standards. Images with eyes closed, heads turned, duplicates, etc. are not shown and are removed from the archives permanently after the artist's rendering is complete.  

Proofing, Viewing, Ordering, Archiving & Refund Policies

• Due to the downloadable nature of digital photography, once files are removed from the studio the sale is final and non-refundable. This includes; online galleries, USB storage devices, prints & all other products sold by Kelly King Photography aka KellyandKingPhotography.com. 

• Once an order is sent to the lab or digital files are submitted to the client either by CD, USB, electronic transfer, online gallery or email, the order is deemed non-refundable.
• Forms of Payment: Cash, ACH bank Transfer (electronic check) and most major credit cards accepted. No interest layaway payment plans are available. 

• Please allow 2-4 weeks for your order to be completed. Some orders may take longer depending on the custom nature of the piece, lab and shipping delays, client and photographer's schedules, etc.  You will be notified by text or e-mail when your order is ready for delivery/installation. If your order is shipped, the client is responsible for any additional charges.

• All ordered images are kept on file for a period of 1 year. Unordered images are removed from our archives after 90 days. Re-orders placed more than 60 days’ after the preview appointment, require a minimum $125 re-order. 

 Copyright

• The Copyright Act protects photographers by giving us the exclusive right to reproduce their photographic works (images). This means unless you have a print release you are not allowed to print images yourself, they must be ordered directly from Kelly King Photography aka Kelly & King Photography, Kelly King. Violations include, but are not limited to, making illegal copies, scanning, printing from home or downloading from our website without written permission to do so. It is illegal to copy or reproduce these photographs in any manner without our permission and violators of this Federal Law will be subject to its civil and criminal penalties.
