I am fully aware this will be for a one time trial session where I will perform to the best of my abilities and up most professional manner to Kawada Photography standards. This will be a complementary make up and hair trial session and in return, you will receive professional watermarked images from ©Kawada Photography. There will be one before and after, and one after, final edited photo digital images and they may be used for portfolio only.
Furthermore, I understand that Photographer holds all rights, including copyrights, to the photographs Found in the U.S. Copyright Act at 17 U.S.C. 106 (http://www.copyright.gov/title17/92chap1.html#106) Copyright to all photographs are property of Kawada Photography and additional written consent will be nessecary. Use of any photographs for social networks must have visible watermarks. It is a breach of this contract to crop/hide Studio logo.
You may not edit, manipulate, modify, copy, scan, reproduce, screen shot, distribute or duplicate any images created by Kawada Photography. Violation of copyright will result in federal © enforcement and/or by signing or placing an order via email you accept liability for usage of the image and acknowledge you will be billed for commercial rate usage on each image starting at $5,000 per image per use. Removal of the logo on any online image will constitute acceptance of a commercial contract. Kawada Photography reserves the right to use any image for display, exhibition, publications, or general promotion and distribution as seen fit by Photographer. Negatives/Original files copyright remain exclusive property of Kawada Photography LLC.
Indemnification:The Photographer shall be held harmless for any and all injury to client during the course of the photography session and the immediately surrounding events.
Attorney’s Fees:If either party to this Contract brings a legal action against the other party to this Contract to secure the specific performance of this Contract, collect damages for breach of this Contract, or otherwise enforce or interpret this Contract, the prevailing party shall recover reasonable attorney’s fees and all costs,premiums for bonds, fees, and other expenses expended or incurred in the action in addition to any other relief that may be awarded.
