Sessions are typically scheduled on weekdays in the morning or the couple hours prior to sunset. Some weekends are available. Photography is all about lighting, so Sarah Avitua Photography does not shoot in midday harsh lighting for outdoor sessions. All sessions are on location and natural light. Exceptions are young children and babies who require a studio session.
Sarah Avitua Photography will not use my photos and likeness in any forms including: media for advertising, studio website, portfolio, demo, editorial or any purpose.
Sarah Avitua photography maintains free creative license with respect to artistry, style and composition of photographs. I agree that I have viewed the photographer's online portfolio and am aware of the photographer's artistic style. Photographer supplies all props and setups.
Client agrees to pay photographer a session fee of $200 plus tax at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee. This fee covers the time and talent of photographer, basic retouching and creative editing of images as determined by the photographer, and a gallery of images to view for ordering. The session fee does NOT include any digital images or prints.
If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hours notice when possible, or decide to completely cancel the shoot, this session fee is forfeited and will not be refunded and new session fee will be required for re-booking. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control. *Texas weather can be extreme and change quickly. Reshedules will only be permitted for weather such as rain where as it is impossible to shoot in. Unfortunately cold, windy, or overcast weather is not as reason to reschedule. Please ALWAYS dress according to the weather. There will be no reshoots based on not wearing the appropriate clothes.
Proofing of client’s images will be available for viewing via a password-protected gallery within three weeks of session date. Only images that meet photographers quality standards are included in final proofing gallery. Images that are out of focus, subjects with eyes closed, incorrect exposure, or any other reason photographer deems less than high quality are immediately deleted and not available for viewing or purchase. Number of images included in proofing gallery vary by session. Sarah Avitua Photography is a portrait studio that strives for quality, not quantity. Raw images are never available. Due to the amount of work required to make each image proof ready, Sarah Avitua Photography will only provide additional proofs or re-edits of original proofs at an additional charge.
Your online gallery will give you access to a professional printing lab. Clients are highly encouraged to only print through the lab provided. Sarah Avitua Photography cannot be held accountable for the quality or color of prints and/or products printed through any other non-professional lab.
Sarah Avitua Photography is not responsable for storing client's images for archival purposes. Please back up all of your digital files.
Once client receives online gallery, they agree to make a collection choice within 7 days. All clients must purchase a digitial collection. Once gallery expires, collection prices increase by 25%.
Photographer is not responsible for the damage of portraits after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits upon receipt.
Photographer is not responsible for any injuries inflicted upon any participating parties.
Copyright & Penalty
Sarah Avitua Photography retains all copyrights to all images created during client’s session. Editing images with any editing software or app (instragram filters, pictapgo, etc) is strictly prohibited.
The performance of this contract on behalf of Sarah Avitua Photography shall be contingent upon acts of God, flood, fire, warfare, government laws or regulations, electrical failure, strikes by suppliers, and/or conditions beyond its control.
