SERVICE CONTRACT

The following contract and its terms will set forth an agreement between MUGSHOT MONKEEZ PHOTO BOOTH ENTERTAINMENT/ANNALYNN CATALASAN (PROVIDER) and the (CLIENT) whose name is listed above (Renter's Full Name) the parties, for photo booth services during the designated service period.  This written agreement sets forth the full, written intentions of both parties and supersedes all other written and/or verbal agreements between the parties.

RESERVATION & DAMAGE DEPOSIT (for PROPS)

A non-refundable booking fee in the amount of $100 of the total balance is due upon booking your event.  The event is only reserved once the booking fee is received.  The remaining balance is due no later than 7 days in advance of the CLIENT'S event date.  If the balance has not been collected by this due date, a $30 late charge will be added to the remaining balance per day that the balance remains unpaid.  If the balance is not paid within 3 days in advance of the event date, the PROVIDER reserves the right to cancel the event.

A fully-refundable damage deposit of $50 will also be collected upon booking your event.  The damage deposit will be refunded within 2 business days of the close of your event if, and only if no props or equipment were damaged by the CLIENT or his/her guests during the event.  Scratches, dents, or nicks larger than the width or circumference of a golf ball is considered damage and therefore results in the forfeit of the deposit.  Breakage, of course, will also result in the forfeit of the deposit.

DAMAGE TO PHOTO BOOTH EQUIPMENT

We never expect anything bad to happen at any of our events, however, "things happen"!  In the event that our photo booth equipment (i.e. cameras, lights, printers, computers, or any other electronics) are damaged by the CLIENT or his/her guests, the CLIENT is responsible to pay $3,000 to cover the replacement of the equipment.

OUTDOOR PHOTO BOOTHS

We hope that the heavens will grant you a perfect day for your outdoor event, but there is a saying that rain on your wedding day is good luck.  That's why it's important that you have a "Plan B".  If you choose to place the photo booth outdoors, we must be in an area that is:

• Totally dry
• Must be on a paved or grassy surface (no dirt!)

If these conditions cannot be met, we may not be able to operate.  If conditions change during the event, the PROVIDER reserves the right to pack up and leave (to protect the valuable photo booth equipment).  In such cases, no refunds will be given.

DATE CHANGES & CANCELLATIONS

Requests for date changes must be made in writing at least (30) days in advance of the original event date.  Change is subject to photo booth availability and receipt of a new rental agreement.  If there is no availability for the alternate date, the booking fee shall be fortfeited and event cancelled.  Any cancellation occuring less than (30) days prior to the event date shall forfeit all payments received.

REFUSAL/DISRUPTION OF SERVICE

In the rare occurence, we reserve the right to immediately refuse service, pack up, and depart from the venue.  Service will be disrupted without a refund if:

• The photo booth attendants are harassed, threatened, or abused by any guests.
• The equipment is damaged by the guests.
• The photo booth props are being misused and/or damaged intentionally by guests.

MODEL/TALENT RELEASE

We realize some clients of ours as well as others wish the photos to remain private which is why we provide the option above.  We'd love to use your photos on our website, but understand your right to privacy.

Client agrees to and understands the following:
All guests using the photo booth hereby give the PROVIDER the right and permission to copyright and use photographic portraits or pictures of any photo booth user who may be included intact or in part, made through any media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose.  In additon, I hereby release and discharge the PROVIDER from any liability that may occur to be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy.
