  • This is a legally binding contract between Alyece Fuller, Alyece Nicole Photography and the client stated above. It supersedes all previous agreements (verbal or written) between parties. The only way to add or change this agreement is to do so in writing, signed by all parties. If any parties waive or alter part of this agreement, the rest of the agreement remains intact.

  • Cancellations

    If the session is cancelled or postponed by the client, the nonrefundable retainer payment will not be returned, it being the agreed loss suffered by the photographer due to cancellation. If the session is cancelled within 30 days of the scheduled date, the full amount will still require payment and will be non-refundable. In the unlikely event the photographer determines that she is unable to complete the coverage due to unforeseen circumstances, another photographer will be found for you or all money (including the deposit) will be returned to the client.

     

    Limit of Liability

    In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. Any legal matters will be held in the photographer’s home state, any legal fees incurred by the photographer as a result of a client prosecution will be paid by the client.

     

    Copyright, Reproduction, and Model Release

    The copyright of the photographs is retained by the photographer at all times throughout the world. Where a copy of photographs has been included for the clients as part of the photograph collection, these photographs will include a print release and may be printed, and or displayed online, for personal use. Commercial uses must be expressly approved in written form by the photographer and include citation. The photographer retains the right to use the photographs for the purposes of advertising or otherwise promoting her work. Client agrees not to sell any of the files or prints without written permission from the photographer. The client agrees to have themselves and others in their photographs pictured . The client agrees that they are signing a model release to allow the use of their photographs to be used for the photographer’s business purposes.

     

    Social Media

    This clause applies to all social media, including Facebook and blogs. When published online it is required that citation of photographer be made. The client agrees that they will under no circumstances alter the photographer’s photographs that are placed in public on the internet. As a photographer, I need photographs that are placed online to be accurate representations of my work so that future clients have a good understanding of the type of photographs that they’ll receive. The client agrees to be responsible for any family member or friend who posts our photographs online and agrees that they cannot be cropped (with the exception of the forced cropping for Facebook’s Timeline), altered in color, or edited in any way.

     

    Retention of Delivered Files

    Once the JPEG files are delivered to the client, it is the client’s sole responsibility to protect and retain their images for the future. It is highly recommended that DVDs or USB drives be duplicated and stored in multiple locations that are cool and dry. (Technology can be fickle; one of the best ways to ensure the client’s images will last for generations is for the client to print them.) If client requires old files to be duplicated by the photographer, and they are still within the photographer’s possession, a restocking fee may be applied.

     

    Satisfaction & Accuracy

    The client agrees that the work delivered will be of a similar style and caliber to those photographs on our website and blog, and that the photographer will have complete creative control during the photographs and in post-processing. The images will be delivered in JPEG format with a mix of color and black and white images, as deemed appropriate by the photographer. No re-editing will be done after the final edited copies are presented to the client.

    The client agrees that the photographer can only capture the moment(s) that happens; weather, location, schedule complications, time restraints and subject’s ability to cooperate, are all factors in the quality of the photographs. The photographer will not edit for physical size, hair, nor any other physical appearance issue other than blemishes.

     

    Interference/Obstruction

    No Clients, guests and attendants or employees of the Client may impede the photographer when she is shooting or performing her duties; failure to comply with this may result in missed moments or fewer delivered images. The responsibility of this will fall on the client to ensure all are in compliance. The private portraits with the Client(s) must remain private, in addition to the photographer(s) of Alyece Nicole Photography. No other individuals of any respect may impede on this private moment. Lighting deficiencies at venues may interfere with the photographer’s ability. all attempts to provide adequate lighting situations must be made by the client. No other professional photographers will be hired by the client or located on site photographing the client unless otherwise approved by Alyece Nicole Photography.

     

    Food/Breaks

    The photographer(s) will be allowed one 20 minute break at their own discretion, and bathroom breaks when necessary. Each photographer will be provided a full guest meal for weddings lasting longer than 4 hours. If no meal is provided, the photographer(s) reserves the right to go off-site for a meal for 45 minutes. The undersigned have read and understood the above contract and agree to the terms andconditions in their entirety.

  • CONSENT AND NOTICE REGARDING ELECTRONIC COMMUNICATIONS FOR
    Alyece Nicole Photography


    1. Electronic Signature Agreement. By selecting the "Submit" button, you are signing this Agreement electronically. You agree your electronic signature is the legal equivalent of your manual signature on this Agreement. By selecting "Submit" you consent to be legally bound by this Agreement's terms and conditions. You further agree that your use of a key pad, mouse or other device to select an item, button, icon or similar act/action, or to otherwise contact Alyece Nicole Photography, or in accessing or making any transaction regarding any agreement, acknowledgement, consent terms, disclosures or conditions constitutes your signature (hereafter referred to as "E-Signature"), acceptance and agreement as if actually signed by you in writing. You also agree that no certification authority or other third party verification is necessary to validate your E-Signature and that the lack of such certification or third party verification will not in any way affect the enforceability of your E-Signature or any resulting contract between you and Alyece Nicole Photography. You also represent that you are authorized to enter into this Agreement for all persons who are involved in the session and that such persons will be bound by the terms of this Agreement. You further agree that each use of your E-Signature in obtaining an Alyece Nicole Photography service constitutes your agreement to be bound by the terms and conditions of the Alyece Nicole Photography Disclosures and Agreements as they exist on the date of your E-Signature.

    2. Consent to Electronic Delivery. You specifically agree to receive and/or obtain any and all ANP related "Electronic Communications" (defined below) via online. The term "Electronic Communications" includes, but is not limited to, any and all current and future notices and/or disclosures that various federal and/or state laws or regulations require that we provide to you, as well as such other documents, statements, data, records and any other communications regarding your relationship with Alyece Nicole Photography. You acknowledge that, for your records, you are able to use the internet to retain Electronic Communications by printing and/or downloading and saving this Agreement and any other agreements and Electronic Communications, documents, or records that you agree to using your E-Signature. You accept Electronic Communications provided via the internet as reasonable and proper notice, for the purpose of any and all laws, rules, and regulations, and agree that such electronic form fully satisfies any requirement that such communications be provided to you in writing or in a form that you may keep.


    3. Paper version of Electronic Communications. You may request a paper version of an Electronic Communication. You acknowledge that Alyece Nicole Photography reserves the right to charge you a reasonable fee for the production and mailing of paper versions of Electronic Communications.     4. Revocation of electronic delivery. You have the right to withdraw your consent to receive/obtain communications via online delivery at any time. If you wish to withdraw your consent, contact us at (214) 980-3008.


    5. Valid and current email address, notification and updates. Your current valid email address is required in order for you to obtain any contracts and/or documents. You agree to keep Alyece Nicole Photography informed of any changes in your email address. You may modify your email address by submitting a written request to ANP, by phone call or submit a secure message thru your email provider. Alyece Nicole Photography may notify you through email when an Electronic Communication or updated agreement pertaining to your documents is available. Alyece Nicole Photography may also use the internet for Electronic Communications. It is your responsibility to check your emails regularly to check for Electronic Communications and to check for updates to this Agreement.
