CONSUMER DISCLOSURES

• Member may cancel with Sarlo Enterprises, LLC (DBA C3 ATHLETICS) penalty-free within three days, exclusive of holidays and weekends, of its making, upon e-mailing or delivery of written notice to Sarlo Enterprises, LLC (DBA C3 ATHLETICS), and Sarlo Enterprises, LLC (DBA C3 ATHLETICS) will refund upon such notice all monies paid under the contract, except that Sarlo Enterprises, LLC (DBA C3 ATHLETICS) may retain an amount computed by dividing the number of completed days in the contract term or, if appropriate, the number of occasions since the making of the contract or, if appropriate, by the number of occasions that Sarlo Enterprises, LLC (DBA C3 ATHLETICS) services have been rendered into the total contract price, and multiplying the result by the number of completed days that have passed since the making of the contract. A refund shall be issued within 30 days after receipt of the notice of cancellation made within the 3-day provision.
  
  
• All requests to cancel outside of the 3-day provision period must be emailed to info@c3athletics.co with a 30-day advanced written notice. The cancellation notice automatically terminates the membership to Sarlo Enterprises, LLC (DBA C3 Athletics) and any obligation to any entity the Sarlo Enterprises, LLC (DBA C3 ATHLETICS) has assigned the member contract.
  
  
• Member may cancel with Sarlo Enterprises, LLC (DBA C3 ATHLETICS) if the contracting business location of Sarlo Enterprises, LLC (DBA C3 ATHLETICS) goes out of business or moves its facilities more than ten driving miles from the business location designated in such contract and fails to provide, within 30 days, a facility of equal quality located within ten driving miles of the business location designated in such contract at no additional cost to the buyer.
  
  
• Sarlo Enterprises, LLC (DBA C3 ATHLETICS) membership is cancelable should the member die or become physically unable to avail him/herself of a substantial portion of those services that he/she used from the commencement of Sarlo Enterprises, LLC (DBA C3 ATHLETICS) until the time of disability, with refund of funds paid or accepted in payment of the contract in an amount computed by dividing the contract price by the number of weeks in the contract term and multiplying the result by the number of weeks remaining in the contract term. Buyer or the buyer's estate seeking relief under this paragraph must provide proof of disability or death. A physical disability sufficient to warrant cancellation of Sarlo Enterprises, LLC (DBA C3 ATHLETICS) by the buyer shall be established if the buyer furnishes to the health studio a certification of such disability by a physician licensed under chapter 458, chapter 459, chapter 460, or chapter 461 to the extent the diagnosis or treatment of the disability is within the physician's scope of practice.
  
  
• If there is a refund due, the refund shall be an amount computed by dividing the contract price by the number of weeks in the contract term and multiplying the results by the number of weeks remaining in the term. The business location of Sarlo Enterprises, LLC (DBA C3 ATHLETICS) may not be deemed out of business when temporarily closed for repair and renovation of the premises:
  
  
  • Upon sale, for not more than fourteen consecutive days or
  • During ownership, for not more than seven consecutive days and not more than two periods of seven consecutive days in any calendar year. A refund shall be issued within 30 days after receipt of the notice of cancellation made pursuant to this paragraph.
    
    
• Should Sarlo Enterprises, LLC (DBA C3 ATHLETICS) go out of business, the member is advised to contact the Florida Department of Agriculture and Consumer Services.
  
  
• The initial contract with Sarlo Enterprises, LLC (DBA C3 ATHLETICS) will not be for a period in excess of thirty (30) days. Renewal contracts may not be executed, and the fee therefore paid until the preceding contract expires.
  
  
• If Sarlo Enterprises, LLC (DBA C3 ATHLETICS) requires a buyer to furnish identification upon entry to the facility and as a condition of using the services of the health studio, the health studio shall provide the buyer with the means of such identification.

SHOULD YOU (THE BUYER) CHOOSE TO PAY FOR MORE THAN ONE MONTH OF SARLO ENTERPRISES, LLC (DBA C3 ATHLETICS) IN ADVANCE, BE AWARE THAT YOU ARE PAYING FOR FUTURE SERVICES AND MAY BE RISKING LOSS OF YOUR MONEY IN THE EVENT THAT THIS HEALTH STUDIO AND OR BUSINESS LOCATION CEASES TO OPERATE. THIS HEALTH STUDIO IS NOT REQUIRED BY FLORIDA LAW TO PROVIDE ANY SECURITY, AND THERE MAY NOT BE OTHER PROTECTIONS PROVIDED TO YOU SHOULD YOU CHOOSE TO PAY IN ADVANCE.

PROVISIONS. 

Sarlo Enterprises, LLC (DBA C3 ATHLETICS) will provide fitness training. Sarlo Enterprises, LLC (DBA C3 ATHLETICS) may be unavailable during repair and maintenance, special events, programs, or private parties, or by management’s schedule for these events.

MEMBER’S HEALTH WARRANTY.

The member warrants and represents that the member or any family member or guest entitled to use the facilities of Sarlo Enterprises, LLC (DBA C3 ATHLETICS) under the terms of membership has no disability, impairment, or ailment preventing him/her from engaging in active or passive exercise, or that will be detrimental or adverse to such person’s health, safety, or physical condition if he/she does so engage or participate. The member acknowledges and agrees that: 1) Sarlo Enterprises, LLC (DBA C3 ATHLETICS) will rely on the foregoing warranty in issuing the membership; 2) Sarlo Enterprises, LLC (DBA C3 ATHLETICS) shall have no obligation to perform a fitness assessment or similar testing to determine the member’s physical condition; 3) if any fitness assessment or similar testing is performed by Sarlo Enterprises, LLC (DBA C3 ATHLETICS), it is solely for the purpose of providing comparative data with which the member can track progress in a program and is not for diagnostic purposes. 4) Sarlo Enterprises, LLC (DBA C3 ATHLETICS) shall not be subject to any claim, demand, or injury whatsoever on account of Sarlo Enterprises, LLC (DBA C3 ATHLETICS) evaluation or interpretation of such fitness assessment or similar testing. 5) Sarlo Enterprises, LLC (DBA C3 ATHLETICS) shall not be liable for any injury arising out of the member’s disability impairment or ailment preventing him/her from engaging in active or passive exercise, or that would be detrimental or adverse to such person’s health, safety or physical condition if he/she does so engage or participate. Each member and guest should be aware of his/her medical history and should consult with a physician prior to engaging in exercise or continuing to exercise if a medical condition appears or appears to be developing.

LIABILITY AND WAIVER OF LIABILITY.

Each member of Sarlo Enterprises, LLC (DBA C3 ATHLETICS) shall be liable for any property damage and/or personal injury (caused by the member, member’s family, guest, or any other person) at Sarlo Enterprises, LLC (DBA C3 ATHLETICS), or any activity or function operated, arranged or sponsored by Sarlo Enterprises, LLC (DBA C3 ATHLETICS). It shall be the obligation of the member to pay for any costs involved upon presentation of a statement thereof. Any and all use of Sarlo Enterprises, LLC (DBA C3 ATHLETICS) facilities, or participation in Sarlo Enterprises, LLC (DBA C3 ATHLETICS), activities operated, arranged, or sponsored by Sarlo Enterprises, LLC (DBA C3 ATHLETICS), either on or off of Sarlo Enterprises, LLC (DBA C3 ATHLETICS) premises by the member, member’s family or guest(s) shall be AT SUCH PERSON’S OWN RISK. Sarlo Enterprises, LLC shall not be liable for any injuries or damages to such person or the property of such person or be subject to any claim, demand, injury, or damages. The member individually, and on behalf of the member’s personal representative, heirs, administrators, assigns, and successors do hereby expressly forever release and discharge Sarlo Enterprises, LLC (DBA C3 ATHLETICS), its successors and assigns, as well as its officers, agents, and employees from all such claims, demands, actions, or causes of action.

SUSPENSION/TERMINATION OF MEMBERSHIP BY MANAGEMENT.

Management has the right to suspend and/or terminate any membership for non-payment of membership dues or for behavior inimical to the enjoyment of Sarlo Enterprises, LLC (DBA C3 ATHLETICS) by other members and staff for any reason deemed sufficient in the sole discretion of management.

PICTURE AND VIDEO RELEASE.

I hereby grant permission to the rights to Sarlo Enterprises, LLC (DBA C3 ATHLETICS) to my image, likeness, and sound of my voice as recorded on audio or videotape without payment or any other consideration. I understand that my image may be edited, copied, exhibited, published, or distributed, and I waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording. I also understand that this material may be used in diverse promotional settings within an unrestricted geographic area.

SHARING

By signing this membership agreement, you agree not to share any workouts composed by Sarlo Enterprises, LLC (DBA C3 Athletics) with any outside party other than those included in your immediate family. You also agree not to share or post any workouts on social media and online platforms. Any outside sharing, including on all social media and online platforms other than with your immediate family, will result in the immediate termination of your membership.
