As the photographer, legally, SLB Photography retains the copyright of all images. Due to this, SLB Photography, and its legal representatives and assigns, have the unrestricted right to use and publish photographs of me, or members of my family, or in which we may be included, for editorial trade, advertising, and any other purpose and in any manner and medium; and to alter the same without restriction. I hereby release SLB Photography and his or her legal representatives and assigns from all claims and liability relating to said photograph's.

While SLB Photography retains the right to use images for furture purposes, it also does it's best to honor the wishes of it's clients. If, for any reason, you do not want the photos of you or your party used, please add some preference notes below.  

Product Delivery

Though times may vary, photographs from full-length portrait photography sessions generally take 3-4 weeks for delivery. Mini session photos generally take 2-3 weeks for delivery. These are loose time frames. SLB Photography makes every attempt to deliver photos as early as possible.

Included Edits

All photos presented to clients are touched up and edited as SLB Photography sees fit. In general, temporary blemishes and discolorations of skin tones will be adjusted. Permanent facial or bodily features will not be edited unless requested in writing on this document in Section A. Some edit requests may require an additional fee. Photos are sent as a digital download link. The link is sent to the email address provided in Section A. Furthermore, the images may never be adjusted or edited by anyone other than the photographer.  If you need additional edits, please reach out to SLB Photography.

Print Release

Regarding delivered images, the client is hereby granted a license by SLB Photography, to reproduce and display the images in digital or print form, for personal use only. SLB Photography retains the copyright to all images and derivative works thereof.  License does not include use that results in financial gain, including but not limited to: advertising, print sale profits stock photography, or resale of any nature. The client may not use any of these images for commercial or editorial purposes, or enter any of these images into competition without the express written permission of SLB Photography. The purchase of the original files releases SLB Photography from any liability due to loss or damage of the images, and also releases SLB Photography from any obligation to maintain copies of any digital file, image, or photograph. The client is responsible for creating back-ups of the digital content. SLB Photography will retain the images for 30 days.  

I am aware that certain activities and actions that take place during my photography session with the Photographer present certain risks including, but not limited to, bodily injury, death, illness, loss or damage to personal property, and other safety-related dangers.  I further understand that indoor and outdoor sessions present inherent risks of personal injury or sickness, such as falling or tripping, bug bites, forces of nature such as lightning strikes, accidents by automobile or other conveyance.  In the event that animals are to be used in the photography session, I understand that even the best behaved animals can be unpredictable and may cause damage or injury not limited to biting, scratching, tearing clothing, urinating and defecation.  I hereby assume all of the risks of participating in this activity or event, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.  I understand these risks, recognize that these dangers cannot be eliminated, and acknowledge other dangers not mentioned may also exist.  I understand the physical requirements of participation in these activities and affirm I meet these requirements, and that my physical and mental health is good, and that I am not under a doctor’s care for any condition that might endanger other participants or myself.  I certify that I am voluntarily participating in these activities and assume all risks, consequences, and potential liability for this participation.

I understand that Photographer, and/or its assistants, may not possess the required training or equipment to handle incidents that may occur.  I hereby release Photographer, its employees, staff, instructors, volunteers, and representatives, as well as, any owners and lessors of premises where session may take place from any and all liability claims, causes of action, debts, and demands that may arise as a result of participation in these activities.  In the event that a lawsuit is filed, I agree to do so only in the country of the United States, in the State of Connecticut, and further agree that the substantive law of the State shall apply in that action without regard to the conflict of the rules of that State.  This document shall also serve as a release and assumption of risk for my heirs, personal representatives, executors, administrators, and members of my family.

If Photographer cannot perform this agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness, then Photographer shall return the deposit to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer.  In the event the Photographer fails to perform for any other reason, Photographer shall not be liable for any amount in excess of the retail value of the client’s order.

Photographer reserves the right to cancel or change activities without prior notice, and reserves the right to cancel the session of any participant it deems unable to meet safety requirements.  I have had sufficient time to read this entire document.  I have read and understood it, and agree to be bound by its terms.

Photographer schedules its events sometimes months in advance and does its best to predict the best times and conditions for photography.  However, I understand and stipulate that Mother Nature is unpredictable and that it is impossible for Photographer to truly know what will happen.  Therefore, I agree to hold Photographer harmless if conditions do not meet my expectations.  This includes, but is not limited to, weather, light, and growing conditions, rain, drought, lack of blooming, minimal color, lack of water flow, and so forth.

As a parent or guardian of participant(s), I acknowledge reading this form and agree to all the provisions above.  In addition to the above release and assumption of risk, I also give permission for Photographer, assistants, staff, volunteers, and emergency personnel to make necessary first aid decisions in the event of an accident, injury, or illness to the below named participant(s).
