    Subscriber Agreement

    The undersigned Subscriber and Quick Search hereby make the following agreement:

    1. Quick Search has access to consumer reports from one or more consumer reporting agencies.

    2. Subscriber shall request Consumer Report for Employment Purposes, for its own one time use, pursuant to procedures prescribed by Quick Search from time to time only when it is considering the individual inquired upon for employment, promotion, re-assignment or retention as an employee, and for no other purpose.

    3. Subscriber certifies that it will not request a Consumer Report for Employment Purposes unless:

    a. A clear and conspicuous disclosure and authorization form is first made in writing to the consumer before the report is obtained, in a document that consists solely of the disclosure and authorization form that a consumer report may be obtained for employment purposes.

    b. The consumer has authorized in writing the procurement of the report, before a report is requested, which is supplied to the Subscriber by Quick Search.

    c. Information from the Consumer Report for Employment Purposes will not be used in violation of any applicable federal or state equal employment opportunity law or regulation.

    4. Subscriber further certifies that before taking adverse in whole or part based on the Consumer Report for Employment Purposes, it will provide notice to the consumer of the contemplated action and include:

    a. A copy of the Consumer Report for Employment Purposes; and

    b. A copy of the consumer’s rights in the format approved by the Consumer Financial Protection Bureau, which notice shall be supplied to the Subscriber by Quick Search.

    5. After taking adverse action, based in whole or in part, on information contained in a consumer report, Subscriber will provide notice of that action and (a) provide the name, address and telephone number of Quick Search; (b) inform the consumer that he/she is entitled to a free copy of the report, and has the right to dispute the report with Quick Search; (c) inform the consumer that Quick Search cannot tell them the specific reasons why adverse action was taken; and (d) copy of consumer rights under the FCRA and copy of the report.

    6. Subscriber agrees that it shall hold the report in strict confidence, and not disclose it to any third parties not involved in the employment decision, and Subscriber will protect the information from unauthorized internal and external access.

    7. Subscriber agrees that it shall maintain records of all disclosures, authorizations, consumer reports, and adverse action taken for a period of no less than six years, regardless of employment decision.

    8. With just cause, such as delinquency or violation of the terms of this contract or a legal requirement, either Quick Search or subscriber may, upon its election, cancel this Agreement immediately.

    9. Failure to comply with the Fair Credit Reporting Act requirements can result in state or federal enforcement action, as well as, private lawsuits. In addition, any person who knowingly and willfully obtains a consumer report under false pretenses may face criminal prosecution, resulting in a fine and up to two years in prison, 15 U.S.C. §1681q.

    10. When Subscriber disposes of any report, it shall cause such to be destroyed by cross shredding, burning or electronic destruction, as required by regulations issued by the Federal Trade Commission, which results in the material being unreadable.

    Consent and Notice Regarding Electronic Signatures and Electronic Communication 

  • 1. Electronic Signature Agreement. By selecting the "I Accept" button and typing your legal name in the signatures section, you are signing this Agreement electronically. You agree your electronic signature is the legal equivalent of your manual signature on this Agreement. By selecting "I Accept" you consent to be legally bound by this Agreement's terms and conditions. You further agree that your use of a key pad, mouse or other device to select an item, button, icon or similar act/action, or to otherwise provide Service Provider instructions via internet, or in accessing or making any transaction regarding any agreement, acknowledgement, consent terms, disclosures or conditions constitutes your signature (hereafter referred to as "E-Signature"), acceptance and agreement as if actually signed by you in writing. You also agree that no certification authority or other third party verification is necessary to validate your E-Signature and that the lack of such certification or third party verification will not in any way affect the enforceability of your E-Signature or any resulting contract between you and Service Provider. You also represent that you are authorized to enter into this Agreement for all persons who own or are authorized to access any of your accounts and that such persons will be bound by the terms of this Agreement. You further agree that each use of your E-Signature in obtaining a Service Provider service constitutes your agreement to be bound by the terms and conditions of the Service Provider Disclosures and Agreements as they exist on the date of your E-Signature.

     2. Consent to Electronic Delivery. You specifically agree to receive and/or obtain any and all Service Provider related "Electronic Communications" (defined below) via email. The term "Electronic Communications" includes, but is not limited to, any and all current and future notices and/or disclosures that various federal and/or state laws or regulations require that we provide to you, as well as such other documents, statements, data, records and any other communications regarding your relationship with Service Provider. You acknowledge that, for your records, you are able to use Service Provider to retain Electronic Communications by printing and/or downloading and saving this Agreement and any other agreements and Electronic Communications, documents, or records that you agree to using your E-Signature. You accept Electronic Communications provided via Service Provider as reasonable and proper notice, for the purpose of any and all laws, rules, and regulations, and agree that such electronic form fully satisfies any requirement that such communications be provided to you in writing or in a form that you may keep.

    3. Paper version of Electronic Communications. You may request a paper version of an Electronic Communication. You acknowledge that Service Provider reserves the right to charge you a reasonable fee for the production and mailing of paper versions of Electronic Communications. To request a paper copy of an Electronic Communication contact us at the Service Provider phone number listed at the top of this agreement.

    4. Revocation of electronic delivery. You have the right to withdraw your consent to receive/obtain communications via electronic delivery from Service Provider at any time. You acknowledge that Service Provider reserves the right to restrict or terminate your access to Service Provider if you withdraw your consent to receive Electronic Communications. If you wish to withdraw your consent, contact us at the Service Provider phone number listed at the top of this agreement.

    5. Valid and current email address, notification and updates. Your current valid email address is required in order for you to obtain Service Provider services. You agree to keep Service Provider informed of any changes in your email address. You may modify your email address by submitting a written request to Service Provider, or by submitting an email to Service Provider from your new email address with "email address change" as the subject of the email. Service Provider may notify you through email when an Electronic Communication or updated agreement pertaining to Service Provider is available. It is your responsibility to check for Electronic Communications and to check for updates to this Agreement.

    6. Controlling Agreement. This Agreement supplements and modifies other agreements that you may have with Service Provider. To the extent that this agreement and another agreement contain conflicting provisions, the provisions in this agreement will control (with the exception of provisions in another agreement for an electronic service which provisions specify the necessary hardware, software and operating system, in which such other provision controls). All other obligations of the parties remain subject to the terms and conditions of any other agreement.
