The person whose signature appears on this contract, know as “client”, agree that Celena Dixson, known as “Chasing Butterflies Photography”, shall provide services to photograph to the best of her abilities, in the manner described in this document. This is a binding contract, which incorporates the entire understanding of the parties, and any modifications must be in writing, signed by both parties and physically attached to the original agreement.  

In the event that any part of this Agreement is found to be invalid or unenforceable, the remainder of this Agreement shall remain valid and enforceable. Any failure by one or both parties to enforce a provision of this Agreement shall not constitute a waiver of any other portion or provision of this Agreement.

Coverage:

Every reasonable effort will be made to take requested pictures, but no specific pose or photograph can be promised. Any lists supplied will be used for organizational purposes only. Images determined by the photographer to be substandard or duplicated may be edited out. The photographer will use her professional judgment and sole discretion to select which photos to deliver. Such selection shall constitute all images that will be made available to Client. Number of photos may vary from client to client depending on many factors including but not limited to: the number of people, cooperation of subjects photographed, efficiency of the shoot, locations and lighting.

Payment Arrangements:

Payment must be made in full to secure session.

A minimum of a 100% retainer is required to secure the date and time payable on the execution of this agreement. This retainer is non-refundable in the event of cancellation or rescheduling by the client for the following Portrait Event(Excluding sickness or emergency situations), also it being the agreed loss suffered by the photographer due to photographer’s cancelling. Photos may be available sooner but please allow at least up to 2 weeks after the shoot date for completion.

If for any reason client cancels this contract before the shoot date, photographer will keep the retainer. Cancellation must be made in email or writing.

In the event that Client reschedules the shoot, the retainer will be put towards the rescheduled shoot, as long as the shoot is scheduled within 2 weeks.

Copyright

The photographer retains the entire copyright in the photographs at all times throughout the world. Where digital image files of photographs have been provided to the client as part of their photo shoot collection they may be used for personal use, but not for commercial use.  Digital photos may not be altered in any way including social media filters.

 Copyright: All photographs taken by Chasing Butterflies Photography/Celena Dixson are her property, will remain her property and are protected by the United States Copyright Laws (USC Title 17). Client hereby waives any claims for ownership, income, editorial control and use of the images. Violators of this federal law will be subject to its civil and criminal penalties.
