      Standard Poodle Purchase Agreement

      (Limited Registration)

      This Standard Poodle Purchase Agreement is entered into on _________________ between Heidi Steinert/Hometown Poodles (hereinafter “Breeder”) and __________ (hereinafter “Buyer”) and concerns the purchase of a Standard Poodle Puppy (hereinafter “Puppy”) known to Breeder as ____________________ .

      Puppy is defined here to be a Standard Poodle Puppy which is in good health at the time of sale, and embodies the characteristics of the Standard Poodle breed.  This Puppy is purebred and the litter has been registered with the American Kennel Club.

      Limited Registration

      This Puppy is registered with a limited registration, which will prohibit breeding and registering offspring.  The Buyer agrees this Puppy is to be spayed/neutered at the appropriate age (6-24 months) allowing for some sexual maturity of the Puppy.  THE AKC REGISTRATION PAPERS FOR THIS PUPPY WILL BE RELEASED TO THE NEW OWNER ON VETERINARIAN VERIFICATION OF THE SPAY/NEUTER PROCEDURE.  THIS VERIFICATION (COPY OF ORIGINAL) MUST BE MAILED DIRECTLY TO BREEDER)  If found that this Puppy has been used for mixed breed production or breeding, this contract will have been breached and will render this contract and its contents null and void and Breeder will retain the right to reclaim Puppy.

      Breeder Guarantees

      The Breeder guarantees the above described Puppy to be healthy at the time of the sale and has received the appropriate shots and worming schedule for the Puppy’s age.  This does not mean that the puppy is completely protected from diseases.  The Breeder recommends that the puppy not be exposed to areas of high risk (pet stores, dog parks) until the series of puppy vaccinations has been completed and a licensed veterinarian states the puppy’s protection is complete.  The Breeder will provide the Buyer with a Health Record detailing the treatment the Puppy has received under the Breeder’s care and future care the Breeder feels is essential to the Puppy’s well-being.  The Breeder does not guarantee against worms and parasites that can be effectively eliminated with reasonable licensed veterinarian treatment.  The Breeder does not guarantee resulting Puppy’s adult size, coat quality, coat color, teeth or bite, temperament, or adaptability.  Adult size and coat colors cannot be determined during the first few years and is therefore at risk to the Buyer.  Resulting coat color usually remains within a similar color hue.  Coat quality and color can be a result of diet and health.  The Breeder guarantees this Puppy to be free of any life threatening genetic diseases for a period of one (1) year from date of sale.  Being a carrier for a genetic condition is not grounds for return or refund.   Should the puppy suffer a significant trauma, be found overweight or underweight or to have suffered neglect or abuse this guarantee is void.  Genetic diseases may or may not surface until later in a dog's life-cycle. Some genetic issues can however, become identifiable with a one year period. If at any time during this one year period, Hip Dysplasia, VwD, Addison's or Eye Disease (Eye injuries not covered) is diagnosed by a licensed veterinarian, the Breeder will accept return of the Puppy.  The Puppy is to be returned to the Breeder within 2 weeks of diagnosis at the Buyer’s expense.  The Breeder is not responsible for Puppy care costs incurred by the Buyer including medical expenses.  Upon return of the Puppy, the Breeder will replace the Puppy within 12 months.  If the Breeder cannot replace the Puppy within 12 months, the Buyer will receive a full refund of the purchase price.

      Buyer Responsibilities
      The Buyer agrees to have this Puppy examined by a licensed veterinarian within three days of delivery (unless otherwise agreed upon due to travel, etc.).  Diagnosis of coccidiosis, giarrdia, parasites, or any other type of bacterial infection does not render your Puppy unhealthy under this contract. If the Puppy is found to be other than healthy by the Buyer’s licensed veterinarian, it shall be returned to the Breeder immediately, and the purchase price will be refunded.  Deadline for this refund is one week from the purchase date. The Buyer agrees to maintain the Puppy’s health in good condition, and to provide yearly examinations, vaccinations, worming, heart worm prevention and any other usual procedures necessary to assure good health.  There are many factors that can influence growth and development, such as diet, exercise, weight gain, etc.  The Buyer assumes the responsibility to carry on with the appropriate vaccinations, exercise and feeding schedule, as supplied by the Breeder. The Buyer hereby agrees that if at any time the Buyer cannot take proper care of the Puppy, the Buyer must contact the Breeder and the Breeder will have the first choice to either: (a) take the Puppy back or without refunding any of the purchase price or (b) assist the Buyer in finding a suitable home for the Puppy. The Buyer agrees that the Breeder is not responsible for the actions or safety of this dog once it leaves the Breeder’s possession. The Breeder is not liable for any costs that result from such actions. All provisions of this contract are designed to safeguard the Puppy, the breed in general and/or the community, and as such, violation of any provision will cause damage to the Breeder’s reputation. Failure to comply with any provision will result in the return of the Puppy to the Breeder at the Buyer’s expense. 

      Breeder does not assume any liability for any injury to said Puppy after delivery. The Breeder strongly recommends that the Buyer attend obedience classes with the Puppy and provide proper socialization opportunities for the Puppy.

      The Breeder neither makes nor implies any warranties or guarantees, express or implied, other than those written in the agreement including, without limitation, the warranties of merchantability and fitness. This document constitutes the entire agreement between the Breeder and Buyer with respect to this sale.  Buyer’s signature below indicates that he/she has read, agrees to and does understand all the conditions of this Purchase Agreement and Contract of Sale.
