A. Fees, Payments, and Package Selection:
Retainer Fee:A non-refundable retainer fee is required to secure your session date and time. This fee is collected via Zelle or Venmo at the time of booking and serves as a deposit. It will be deducted from the total cost of your session.
Balance Payment:A final invoice will be sent a few days prior to your session date. The remaining balance must be paid at least 48 hours prior to the session.
Last-Minute Bookings:For sessions booked within one week or less of the session date, full payment is required at the time of booking.Package Updates/Add-Ons:Additional fees may apply for package updates or add-ons, and deposits may be required for any changes.
Digital Package Selection:Digital packages must be selected at the time of booking. This selection will be included in your invoice. Once chosen, upgrades will not be permitted. If you wish to purchase additional images, they will be subject to ala carte pricing.
RAW Images- Unedited Images- are NEVER given or released to a client. You may purchase a single RAW digital at $500 As I am the owner of NCP-copyright and it is my photograph. I only release finished edited work done by myself.
Any request or demand to purchase/acquire the RAW images will NOT be granted.
If you/the client is late over 15 minutes I will cancel the session and you will loose your retainer- no exceptions! My time is as valuable as is yours. Please respect this.
B. Location Costs & Fees
If there are any costs/fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees. The photographer will not guarantee or arrange payment on any location. Creative fee covers travel within 30 minutes of Congers, NY Any location outside of these limits will be subject to an additional charge of $50
C. Rescheduling
If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hours notice, or decide to completely cancel the shoot, this session fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.
Weather:
Photographer's Discretion:
Due to the expensive equipment used for the shoot, the photographer reserves the right to cancel the session if inclement weather presents a risk.
Rescheduling:
If the session is canceled due to weather, the client will be offered the soonest available date to reschedule the session.
Refund Option:
If the offered reschedule dates do not work with the client’s schedule, the client has the option to request a full refund of the total amount paid.
D. Re-shoots / Refunds
Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair or weather related issues, or by not following the recommendations of the photographer. If your child/children are out of control and damaging my equipment and or items in my studio, you will be asked to leave immediately and there will be no refund given. Please respect other peoples property for your safety and mine.
E. Archive
After 6 months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.
F. Payment
All payments are due in full unless payment arrangements have been made. Orders will not be processed until payment in full is received. If client has arranged a payment plan, order will be placed after the final payment has been received.
G. Damage
Photographer is not responsible for the damage of portraits after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits upon receipt.
H. Model Release
I hereby give to Nicole Calore Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others:
a) To copyright the same in the photographer’s name or any other name that he/she may select;
b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and;
I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.
I. Liability
Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.
Nicole Calore Photography is not liable for dissatisfaction of Images due to poor clothing choice, including color, fit or style. Hair style or hair color, including uneven hair dye, or visible grey hairs. Not liable for cosmetic, hygiene issues or choice of foot wear. This is why I give a prep-guide prior to family sessions with suggestions on what to wear and I, Nicole Calore also re-emphasize this in our consultation prior to session.
Also not liable for transition lenses, orthondontia or braces of any kind.
Session Termination:
Nicole Calore Photography reserves the right to end the session if she feels threatened or unsafe due to the actions of the clients.
The session may also be terminated if the clients, including minors, are disrespectful (e.g., throwing objects at the photographer, using inappropriate language, etc.).
The session may be stopped if Nicole Calore Photography believes the clients are putting themselves in harm’s way or acting in an unsafe manner.If any member of the client’s party are uncontrollable or destroying property, Nicole Calore Photography reserves the right to end the session to prevent further issues.
No Refund for Session Termination:
If Nicole Calore Photography decides to terminate the session for any of the reasons mentioned above, the session fee may not be refunded.
If you have minors present during the session, they must always be supervised by a parent or guardian to ensure safety and avoid any injuries. The parent or guardian is responsible for all participants (both minors and adults) before, during, and after the session.
J. Copyright & Penalty Nicole Calore Photography retains all copyrights to all images created during client’s session. A print release will be included with digital files to print portraits for personal use up to designated size listed on print release. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Nicole Calore Photography during client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. If client steals images via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file.
Note from photographer: I work very hard to create images that reflect you and your family, while keeping in line with my artistic vision and creativity. I know you will want to share them and include a sneak-peek for that very reason. However, I ask that you simply link back to my blog/website/facebook page instead of right-clicking, saving, and sharing the image via your own page. I hope that you will respect not only my hard work, but the time, money, and dedication that I have put into training and equipment to capture these images for you. Please do not steal them.
K.Photographic Rendering:
While I capture many images during your session, you will only see images selected by the photographer for previewing. Images with eyes closed, blurred, heads turned, duplicates etc are removed from my archives permanently.
Client cannot alter images in ANY way. Photographer will edit photos for color correction, exposure and basic retouches including blemishes, stray hairs and minor wardrobe malfunctions if possibly needed. Extensive editing at the request of the client can be purchased at an additional fee of $50 per photo.
All photos are shot in color but may be available in black and white upon request of NCP thinks the images is best presented that way.
Final images are individually edited at the full disctretion of the photographer (NCP) and based on her artistic style !
Retouching and Client Appearance:
Standard retouching (including adjustments for color, exposure, and minor blemishes) is included in the photography package.
The Photographer is not responsible for altering the Client’s appearance beyond reasonable retouching. If the Client is dissatisfied with their appearance in the final images, this is not the responsibility of the Photographer.
Reasonable efforts will be made to accommodate requests for additional retouching, but excessive, unrealistic, or major modifications (such as altering body shape, skin texture, or other significant changes) may be refused.
Significant changes to appearance will be considered on a case-by-case basis, and additional fees may apply if the requests are accepted.
Revisions and Final Images:
The Client is entitled to two rounds of revisions for adjustments to the images. These revisions will be made according to the Photographer’s artistic vision and editing style.
Any additional revisions beyond the two rounds will incur an additional fee, which will be determined by the Photographer.
While the Photographer will make efforts to accommodate feedback, final decisions on all edits (including acceptance or rejection of revision requests) are at the sole discretion of the Photographer.
Any revision requests must be submitted no later than two weeks after the gallery delivery. Requests made after this period may be declined or a additional fees of $35 will be charged per digital.
Revised images will be delivered within 1–2 weeks from the date the Photographer confirms receipt of the revision request.
Retouching Details:
Minimal retouching (e.g., small blemishes, tiny stains on clothes) is included. However, for more significant edits, such as wrinkled outfits, removing text from clothing, or other large-scale edits, a fee of $35 or more per image will apply for re-editing.
Proofing and Gallery Delivery:
Proofing Gallery:
You will receive a proofing gallery containing unedited images with watermarks.
Requests to remove the watermark will not be granted, and taking screenshots of the watermarked images is strictly prohibited.
Gallery Delivery Timeline:
Your online proofing gallery will be delivered via email within approximately one week after your shoot date.
You will have 3 days to view the gallery and make your image selections.
Selection Extension:
If you fail to select your images within the 3-day timeframe, a one-time extension may be granted upon request.
If you still do not make your selections after the extension, a $50 reactivation fee will be charged to reopen the gallery for viewing.
Selection Process:
You will receive step-by-step instructions on how to select your images. Once you make your selections, they are final and cannot be swapped for other images — no exceptions.
Review Selections Carefully:
Nicole Calore Photography only edits the images you select, so please review your choices carefully. Once selections are made, they cannot be changed, regardless of the reason.
Final Gallery Delivery:
After receiving your selections, the final gallery is typically delivered within 2–3 weeks via Pic Time Gallery.
Delays in making your selections or submitting additional payments for extra images or editing requests may result in delays in delivering your final gallery.
All images, including both RAW and edited files, will be deleted six (6) months after the session date. Clients must ensure that they save their files in a secure and backed-up location.
If files are lost and more than six months have passed since the session date, there will be no way to retrieve the images. Nicole Calore Photography is not responsible for storing or recovering files beyond this period and will not be held liable for any lost or deleted images.
Image Security and Online Gallery Disclaimer:
Nicole Calore Photography takes reasonable precautions to protect client images during storage and delivery. However, due to the nature of digital systems, online platforms, and internet-based delivery, the Photographer cannot guarantee absolute security.
The Photographer is not responsible for any unauthorized access, downloading, screenshotting, or distribution of images from the client’s online proofing or final galleries.
The Photographer is not liable in the event of a data breach, hacking incident, or other unauthorized access to the Photographer’s computer systems, online galleries, or hosting platforms that may result in the loss, exposure, or misuse of client images.
By booking a session and accepting delivery of digital images via online platforms, the Client acknowledges and accepts these risks and limitations.
Creative Control Clause:
The Photographer holds full creative authority over the composition, editing, and presentation of all images, including but not limited to cropping, color grading, and overall artistic interpretation. The Photographer’s decisions regarding cropping and any other adjustments are final and reflect their artistic vision.
For sessions that require a setup, such as Newborn, Seasonal Mini Sessions, Maternity, and others, the Photographer will have complete creative control in designing and executing the set.
L. SESSION REQUESTS:
*No cameras/camcorders/any type of recording device (this includes cell phone cameras) are allowed during the session unless prior arrangement has been made between client and photographer, including a written agreement. The photographer will not continue if there are other cameras or video taping during the session.
*Session starts at the agreed upon time. It is strongly encouraged that client arrives 15 minutes prior to the start of session. This allows for any last-minute feeding, changing, and relaxing before session begins.
*Please do not bring any children not being photographed to the session. If they are siblings to a new baby, after the sibling/baby photographing part, please make arrangements for the child to be picked up by family or friend. They canot sit still for 2-3 hours.
*Please make sure hair is combed and face is clean and free of runny noses or eyes.
*Please make sure your nails on your hands and feet are clean and if wearing polish that it is fresh. I will not be responsible for fixing nail polish in Photoshop.
*Please avoid eating or drinking red or orange food or drinks before session, as red and orange tend to leave a stain on the face.
*You are coming at your own risk and we do not take responsibility for any sickness and acknowledging that I nor my family/staff have been sick. If however you or I are not well, I will or will ask you to reschedule our session prior your appointment and you will NOT loose your downpayment!!! We will simply reschedule.
*If you or the baby/child show up ill, you will be turned away and you will loose your downpayment and I will not reschedule you.

Health and Safety Clause:
At Nicole Calore Photography, the health and safety of our clients is our top priority. Given the nature of my work with newborns and young children, it is essential to ensure a safe and healthy environment for all involved. If you or your child are feeling unwell, I kindly ask that you reschedule your session to prevent the spread of illness.
Nicole Calore Photography reserves the right to use its discretion and decline service to any client displaying symptoms of illness, including but not limited to a severe runny nose, cough, fever, chills, vomiting, or diarrhea. If illness is present, the session will be rescheduled to a later date.
Thank you for your understanding and cooperation in helping to keep everyone safe and healthy.
M.Ownership of Copyrights:
Nicole Calore Photography retains the copyrights to all images created during your session. The photographer reserves the right to post, submit, or use images from your session for various purposes, including but not limited to:
WebsiteBlog
Social Media (Facebook, Instagram, Twitter, TikTok, etc.)
Promotional materials (flyers, business cards, online ads)
Magazine publications
Photography competitions
Usage Rights:
Nicole Calore Photography holds copyrights to every image in your gallery. You are welcome to share the images through the Pic Time gallery link or using the share options provided.
Once an image is purchased, you will receive print release rights for the digital images you've bought, allowing you to print them as you see fit.
All images in the gallery will be watermarked until they are purchased, at which point the watermark will be removed.
Social Media and Sharing:
When posting purchased digital files on social media (e.g., Facebook, Instagram, Twitter, Pinterest), you may not alter the image in any way (e.g., adding filters, cropping, etc.).
Screenshots of unpurchased images or sharing unpurchased images is a violation of copyright law. Watermarks will only be removed for purchased images.
Alterations:
Re-editing or altering any image is considered copyright infringement and is strictly prohibited.
Images you purchase may be shared on your social media, but no modifications are allowed.
