ASSUMPTION OF RISK - RELEASE & WAIVER OF LIABILITY - PUBLICITY
RELEASE
IN CONSIDERATION of being permitted to engage and participate in axe or hatchet
throwing and related events and activities (hereinafter referred to as “Activities”) provided
and facilitated by CCB Ventures, LLC dba WOODCHUX (“Company”), I hereby agree,
accept and understand the following:
1. I fully understand the risks and completely assume all risks, known and
unknown, of participating in Activities, including the risk of death or serious bodily injury. I
fully accept responsibility for the dangers, hazards, and risks inherent in the Activities.
2. I represent that I am in good health and physically able and ready to
participate in the Activities, and do not have any physical illness, injury or disability that
would make my participation in these Activities unwise or unnecessarily risky or dangerous
to myself or others.
3. I accept and assume all such inherent dangers and risks of bodily injury,
permanent disability, death, and/or property damage, even if caused, in whole or in part, by
the negligence of the Company, and all of their respective members, managers, officers,
directors, shareholders, affiliated organizations and entities, representatives and sponsors,
and all volunteers, contractors, agents, members, and employees.
4. Notwithstanding any other provision of this Agreement, and to the fullest extent
allowed by law, for the valuable consideration of being permitted to participate in the Activities,
I, my estate, heirs, family members, distributees, personal representatives, guardians,
conservators, agents, successors and assigns, hereby freely, expressly, and unconditionally
RELEASE DISCHARGE, AND WAIVE MY RIGHT TO ASSERT ANY CLAIM, DEMAND,
AND/OR CAUSE OF ACTION NOW HAVE OR MAY HAVE IN THE FUTURE AGAINST:
(1) the Company, and its members, shareholders, officers, owners, employees, insurers, agents,
volunteers, subsidiaries, affiliates, successors and assigns, and any of their affiliates, subsidiaries,
respective members, members, shareholders, directors, officers, and related persons and entities,
in their official and individual capacities (the “Company Released Parties”); and (2) the premises
owner and landlord who leases the premises to the Company, together with its members,
shareholders, officers, owners, employees, insurers, agents, volunteers, subsidiaries, affiliates,
successors and assigns, and any of their affiliates, subsidiaries, respective members, members,
shareholders, directors, officers, and related persons and entities, in their official and individual
capacities (the “Landlord Released Parties” and together with the Company Released Parties, the
“Releasees”) for any injury (including without limitation, personal injury (including, but not
limited to, death) physical or psychological injury, pain, suffering, illness, disfigurement,
temporary or permanent disability (including paralysis) to my person, economic or emotional
loss, premises damage or loss, or other damages resulting from my presence on the Company
premises or my participation in the Activity, regardless of whether such injuries or damages
result from the negligence, in whole or in part, strict liability, professional errors or omissions, or
other acts, of myself, the Releasees, and/or any other person(s) in connection with my presence
on the Company premises or my participation in an Activity.
5. This release and waiver of claims is binding on me, my heirs, executors,
administrators, legal representatives, assigns and successors in interest. I understand that I
am giving up my right to sue the Releasees and giving up other valuable and substantial
rights in exchange for being permitted to participate in the Activities.
6. I agree and understand that following all instructions and rules at all times
while participating in the Activities is a requirement for participation. I agree that if I fail to
follow such instructions and rules and act responsibly, I waive any and all right to continue
participating in the Activities and any benefits associated with being a participant.
7. I agree and understand all alcohol on the premises must be authorized and
provided by the Company and outside alcoholic beverages are not permitted on the
premises. If I elect to consume alcohol prior to or during my participation in the Activities, I
agree to assume all risks, known and unknown, related to consuming such alcohol and agree
to be fully responsible and liable for any and all claims, demands, damages, losses, injuries,
liabilities, obligations, costs or expenses of any kind which may arise due to my
consumption of such alcohol (collectively the “Claims”). I hereby agree to indemnify,
defend, and hold harmless the Releasees from any such Claims.
8. I assume the risks associated with alcohol consumption and takes full
responsibility for my own actions, safety and welfare. I agree to strictly adhere to the policies of
the Company and state & local ordinances and laws while in a Company establishment.
9. I agree to exercise ordinary and reasonable care at all times, and to not imbibe
alcohol to the extent that my judgment is impaired. I understand the potential risks associated
with the consumption of alcohol and acknowledge that I do not have or am not aware of any
medical condition(s) that would prevent me from consuming alcohol or would result in any
injury or damage as a result of alcohol consumption. I acknowledge and agree that the Company
shall not be responsible or liable for any accident, injury, theft, loss or damage caused by my
impaired judgment or negligence.
10. I agree and understand that the Company reserves the right to refuse entry,
suspend or cancel my participation in any Activities at any time for any reason whatsoever and
that I may or may not receive a refund.
11. I hereby grant permission to the rights of my image, likeness and sound of my
voice as recorded on audio or video tape without payment or any other consideration. I
understand that my image may be edited, copied, exhibited, published or distributed and waive
the right to inspect or approve the finished product wherein my likeness appears. Additionally, I
waive any right to royalties or other compensation arising or related to the use of my image or
recording.
12. By signing this Release, or digitally acknowledging acceptance of its terms, I
agree that I have read the terms, agree to be bound by the terms and do so voluntarily and
knowingly. If I am signing on behalf of a minor child, I hereby execute this Release on
behalf of a minor child with a full and complete understanding that I am executing a
release and waiver of potential claims on behalf of a minor child and myself.
