This Credit Agreement is made between South Jersey Paper Products ("SJPP") and the Customer ("CUSTOMER" as defined on the Credit Application) (collectively the "PARTIES"). CUSTOMER agrees that all purchases made on or after the date hereof are subject to the following terms and conditions:
1. CUSTOMER grants SJPP permission to verify all information stated herein and herby authorizes SJPP or its agents/assignees to obtain any business and/or personal financial information from time to time, including, without limitation, information from any other consumer reporting agency, credit bureau or other reporting source regarding the undersigned's credit history.
2. CUSTOMER agrees the decision to grant or deny credit to CUSTOMER in any amount is within the sole discretion of SJPP. CUSTOMER is on C.O.D. terms until SJPP has made a decision on credit terms. SJPP encourages CUSTOMER to provide credit card information to SJPP as CUSTOMER's primary form of payment.
3. CUSTOMER agrees that all amounts due to SJPP shall be payable to it per the stated terms on each invoice. All amounts no paid within invoice terms are subject to a finance charge of 1.5% of the outstanding balance per month. SJPP reserves the right, at its sole discretion, to return CUSTOMER to C.O.D. terms if the account is not kept current.
4. CUSTOMER will be charged a $60.00 fee for any check returned as unpaid. SJPP does not accept post dated checks. CUSTOMER agrees that SJPP is not responsible for any fees incurred for returned checks.
The undersigned guarantor hereby unconditionally and irrevocably guarantees payment in full of any and all present and future sums and charges due to SJPP from CUSTOMER, including all attorney's fees and collection fees which may be incurred by SJPP in regards to enforcing this personal guarantee in regards to CUSTOMER's obligation to SJPP. CUSTOMER understands there is no limit to the undersigned guarantor's liability under this Guarantee.
