TRAVEL HAUS TERMS & CONDITIONS
DEPOSIT: A NONREFUNDABLE deposit of $500 per traveler will be required upon booking to reserve your space on the trip. A second payment of $3000 per traveler will be due by November 26, 2021. The final payment is due NO LATER than February 8, 2022, after which time a late fee of $100 per person may apply.
PAYMENTS: All payments MUST be made by cash or check only. Make your checks payable to Travel Haus, Inc.
GROUP REQUIREMENTS: A minimum of 15 paying passengers must be met for this tour to operate. If the tour minimum of 15 paying passengers is not met by November 5, 2021, you will be notified no later than November 19, 2021 that this tour cannot operate and your $500 per person nonrefundable deposit will be refunded. If you have purchased your own airfare, we are not responsible for any penalties incurred if this tour should cancel by November 19, 2021.
AIRFARE: Airfare is NOT included in the price of the trip. This allows travelers to use a variety of means, including airline and credit card points, to purchase their airfare. You are responsible for your own airfare. If the 15 person tour minimum is NOT met prior to the final payment date, any airfare cancellation costs are at the travelers expense.
You must arrive in Seville no later than 4pm on April 21 or you will need to arrange your own transportation between the Seville Airport and the hotel. On April 30, your flight must depart Madrid 11:35 AM or after or you will need to purchase private transfers at an additional cost.
Travel Haus will be happy to assist any travelers in booking airfare and will suggest flights for all travelers to ensure that the group arrives at Seville Airport in a timely manner and we stay on our first day’s schedule. In many cases, Travel Haus may be able to find better airfare than what the published price is showing. If we can provide you with a special contracted rate, the advantage is that the airfare would just require an approx. $200 per person deposit and then the final payment is not due until the final payment of the tour. This would limit your airfare liability if we should not meet the minimum to operate this tour.
PRICE: Price is based on hotels as given, motor coach costs as negotiated, and an exchange rate of 1.20. Should hotels change for reasons beyond our control, or coach companies impose a fuel surcharge, or airlines add taxes/fuel surcharges or should the value of the dollar drop significantly against other currencies, the tour price may increase. Increase in tour price, for whatever reason, will not exceed 10% of list price.
CANCELLATIONS & REFUNDS: If the airline ticket has been purchased, the client will own the ticket and will pay for it in addition to the following cancellation charges.

Cancellations received up to November 26, 2021 will incur a cancellation fee of $500 per person

Cancellations received from November 27, 2021 – February 8, 2022 will incur a cancellation fee of $3000 per person

Cancellations received from February 9, 2022 up to and including the day of departure will incur a cancellation fee of 100% of the total tour price per person.
Travel Haus will try to recover from its vendors part of the cost of the trip, but cannot guarantee what will be recovered for the client. Once a tour has commenced there can be no refunds on unused portions. We strongly recommend that you take out trip cancellation insurance, which we are happy to assist with.
ACCEPTANCE: Your acceptance on this tour is dependent upon Travel Haus receiving your deposit, completed and signed reservation form, insurance waiver and passport copies.
PASSPORTS: Participants require a valid passport with at least 6 months validity from the return date. Travel Haus requires a copy of your passport to be provided to Travel Haus by December 15, 2021. Travel Haus is not and will not be liable for any loss or damage resulting from improper passports or other documents.
PHYSICAL ACTIVITY: This tour requires average physical activity. You should be in good health, able to climb stairs and walk reasonable distances, possibly over uneven grounds and cobblestone streets.
GOOD TRAVELER CODE: Travel is unpredictable by nature. Though we work hard to anticipate any unwelcome surprises, that is not always possible due to the sheer number of variables involved in group travel. An understanding of this as well as a good-natured attitude and a sense of humor will make for an enjoyable experience for all!
PHOTOGRAPHY: Travel Haus reserves the right to take photographs during the course of the tour and to use them for promotional purposes. By booking this tour, participants agree to allow their images to be used in such photographs. Participants who prefer that their images not be used are asked to identify themselves at the time of booking.
NOT INCLUDED: airfare, travel insurance, baggage charges, telephone calls, personal items, individual purchases, room service, meals not listed in itinerary, alcoholic beverages or other special beverages ordered at group meals, optional extensions and everything else not expressly mentioned under “Included.”
CHANGES TO THE ITINERARY: This trip has been organized by Travel Haus and we reserve the right to make changes to the itinerary, if due to unforeseen circumstances, it becomes necessary. If for some reason a change needs to be made, the level of service and quality will be equal to what has been agreed upon in the itinerary. We will advise the group of the change immediately. If the tour should cancel any purchased airfare is the travelers responsibility.
LUGGAGE: While we take every effort to ensure participants’ luggage is handled carefully, Travel Haus cannot be responsible, assume liability or accept claims for loss or damage to luggage. It is essential participants have adequate travel insurance to cover these eventualities.
LIMITS ON TRAVEL HAUS’S RESPONSIBILITY: Tour itineraries are planned in advance. Travel Haus reserves the right to make necessary alterations, should local conditions dictate. When weather or unforeseen conditions beyond our control affect our routes or itinerary the best alternative will be provided. This tour includes the services of operators such as hoteliers, bus transportation, tour guides and other operators who are not employees of Travel Haus. Although we take great care in selecting our international operators who partner with us on these tours, we cannot take responsibility for the conduct of the operators, their employees and agents or for any ramifications of that conduct. Travel Haus is not and will not be liable for any damage or loss to any tour participant or their luggage outside their control including, but not limited to, any act or omission, delay, injury, diversion, cancellation, loss or damage which might occur to a participant or participant’s property by providers of air travel, transportation, accommodation or any service to the client or as a direct or indirect result of acts of God, dangerous incidents, acts of government or other authorities, war, whether declared or not, hostilities, civil disturbances, riots, strikes, theft, pilferage, epidemics, quarantines, medical or customs regulations. For all these reasons, we strongly recommend you have valid comprehensive travel insurance for the duration of this trip.
Passengers agree that Travel Haus, Jerry and Amy Fritz, and/or Linden Hills Gardens, or any associates thereof, will not be held liable in the event of any circumstance that may cause personal distress or injury to any traveler.
Travel Haus acts as agent when making travel reservations with the travel vendor or vendors listed on this invoice. Travel Haus is NOT responsible for any transportation delays, mechanical failures, strikes, cessation of operation of any tour company, airline or charter company, or any act of God, nor any loss of time caused by such delay or cessation.
Be aware that during your participation on vacations booked with Travel Haus Inc, certain risks and dangers may arise beyond our control, including, but not limited to: the hazards of traveling in undeveloped areas; travel by boat, train, automobile, aircraft, or other means of transportation; forces of nature; political unrest; acts of lawlessness or terrorism; and accident or illness in remote regions without means of rapid evacuation or medical facilities. Travel Haus Inc will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. While Travel Haus Inc will use its best efforts to ensure that adequate measures are taken, by agreeing to participate in a vacation and/or optional excursions you agree that you will hold Travel Haus Inc harmless regarding any provision of medical care or the adequacy of any care rendered. Travel Haus Inc is not responsible for such risks and dangers that may arise beyond our control. Payment of your deposit indicates you accept these risks and dangers and agree to hold Travel Haus Inc harmless for such.
FORCE MAJEURE
Travel Haus Inc assume no liability for any loss, damage, or entry of any nature in whole or in part resulting from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by Travel Haus Inc that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the event that any of these conditions apply, Travel Haus Inc shall be excused, discharged, and released from performance to the extent such performance is so limited or prevented, without liability of any kind.
Travel Haus Inc reserves the right to cancel or reschedule any Travel Haus Inc group departure for any reason, including insufficient demand or force majeure (see Force Majeure section above). If a vacation is canceled prior to departure, you will be offered an alternate date for the trip to operate. No refunds will be given if an alternate date has been offered. If an alternate date cannot be offered, then a refund will be given.
