  • A: Data Collection, Credentials, and Billing Honesty

  • If at any time collobrator is out of compliance, there are penalties up to forfeiture of pay. PROVIDERS WITHOUT NEEDED CREDENTIALS MAY NOT PROVIDE SERVICES.

                    Data is due at the time of service with verification from family / client. Delay in data may result in fees, delayed reimbursement, or no reimbursement depending on funding sources and applicable regulations. 
                     
    I attest that the documentation made provided in each record accurately reflect he services provided, diagnosis, treatments, and information as recorded during this session. The electronic health record does accurately reflect my role, relationship, position and intent as indicated by my name, title and capacity for the record.  I attest that this information is true, accurate, and complete to the best of my knowledge. I understand that any falsification, omission, or concealment of material fact may subject me to administrative, civil, or criminal liability.  I understand that an electronic signature has the same legal effect and can be enforced in the same way as a written signature. I agree and understand that these statements are being made under penalty of perjury.
                     
                    By working with any client I attest that I have read all available information in their file as there file functions as each client's person specific training. Furthermore, by accepting a client I attest that my expertise matches the clients needs and that I am a competent provider for that person's specific needs. If I’m not then I will decline working with client or create a client/family action plan on what needs to take place in order for there to be a client need / provider skill match.
                     
                    I commit that all information providing is true and accurate to my knowledge. If at ANY TIME, any information on my part changes that would possibility violate this agreement I must stop seeing clients right away, contact ANGELS and determine an appropriate action plan. Examples would be, if I had a law suit filed against me, have been accused of a crime, my insurance or license lapsed, etc. (this in not an all-inclusive list). If any of my contact information or credentials needs to be updated I will contact Angels Service LLC immediately. 
                     
            · Notices will be in writing and will be deemed given when sent via certified post or scomm in Therap.

  • B: Core Agreements: Our Guiding Philosophies


  • · Serve the best interests of my clients. I will provide the highest quality of care that I am able to with the sole objective of benefitting the client.


    · Be responsible for building and maintaining an effective, healthy, and safe environment and relationship with my clients as their provider. This includes: refraining from and preventing to the best of my ability, behaviors that may be considered sexual during my sessions. I will not date a client, engage in sexual acts, or allow any level of sexual impropriety from my clients or myself. I understand that sexual impropriety will lead to serious consequences.


    · I commit to do no harm, I will conduct a thorough review of each case, making sure that I am competently trained for each specific person that I work with, through review of information in case file and client / family interview to determine appropriate session techniques in order to meet needs and goals. If I see signs of, or suspect and undiagnosed condition or other item of concern I will refer client / family to appropriate services or make an incident report depending on the concern I witness.


    · Only work within my scope of practice and skills. I will evaluate the needs of each recipient and refer the client to another provider if the client requires services beyond my capabilities of my expertise or I will create an approved action plan with client and family to increase my expertise. I will acknowledge any services limitations by refraining from exaggerating the benefits of services.


    · Nurture and upload the inherent worth of all individuals. I will demonstrate compassion, respect, and acceptance of others. I will work to decrease instances of discrimination, mistreatment, abuse, neglect, exploitation, misunderstandings, and prejudice. I understand that all individuals have a right to rights, respect, and dignity. I will uphold client by being respectful, by understanding each specific person's needs and goals, by providing a clean, comfortable, and safe environment (to the extent my control allows), for sessions.


    · Understand there are situations when it is appropriate to decline services to a client because it is in the best interests of the client or for my own personal safety. I will not refuse services based on disability, ethnicity, gender, marital status, physical build, sexual orientation, religious, national affiliation, political views, or social / economic status.


    · Recognize that everyone has the right to provide informed consent to the best of their ability. I understand that a client may suffer emotional and physical harm if a provider fails to listen other client's communication, including verbal, non-verbal, or any other form of communication, and imposes the provider's own beliefs on a situation. I will fully inform my clients of choices relating to their services and disclose policies and limitations that may impact their services.


    · Know and follow relevant good business practices. I’m aware that my behavior and appearance reflects on my professional image and am aware of the type of professional image I want to craft and project.


    · Not accept gifts, compensation, or other benefits intended to influence a decision related to a client. You may accept reasonable gifts that to not compromise client's wellbeing.


    · Maintain clear and honest communication with my clients, my clients team members (family, case manager, etc.) and other professionals.


    · Not use recreational drugs, prescribed drugs, or any other substance that may impact my ability to perform my tasks while providing services to clients.


    · Not actively disrespect a client or colleague or willingly malign another provider. Any provider who demonstrates behavior or lack their of that potentially negatively impacts the well being of the agency, other agencies that are connected, clients, families, or the community it general may face contract termination, remediation, or legal action.


    · I have a basic understanding of what has been shared as what many families what me, as a provider to know. Such as: https://adiaryofamom.com/2013/05/14/what-we-told-them-part-one/


    · Be open to new strategies and information. That even if I am great with one case, the information I have may not apply to my next client. I understand that I am part of a network and that I can reach out any time and find support and well as be a valuable source of support for other.

  • C: Governing Rules

  • We all commit to follow the rules, regulations, and policies. If we need exceptions to the rules we will make a request to Angels Service. 

    Collaborators agree to abide by all policies, procedures, advices, and guidelines issued by ANGELS, the case management CCB of each client, the Colorado Department of Human Services, the Colorado Department of Health Care Policy Financing, Colorado Department of Health and Environment and their designees, as they currently exist or may hereafter be amended.

    To the extent authorized by law, collaboratorss shall indemnify and hold harmless ANGELS and all those connected, the CCB, the State of Colorado, the Colorado Department of Human Services, and the Colorado Department of Health Care, Policy and Financing their employees, officers, agents, and assignees from and against any and all claims, damages, liability, and court award including costs, expenses, and attorney fees incurred as a result of any act or omission by the contractor, subcontractor, or by its employees, agents, sub-subcontractors, or assignees.

  • D: I will follow the service plan and ask for changes when needed.

  • All services must be within the definition of approved services. We all understand that we mustn't go outside of the service plan without written permission. Must be within the schedule approved and all work is subject to inspection of quality. 

     · All providers may only use the units designated for their specific use, in the amount, scope, frequency, and duration outlined in the service plan. Each service may only be provided for the time span listed for that service.
                 
                    · If there is a special circumstance that requires a mass amount of units be used and the family wishes to change the expectation of services being available throughout the entire year, the provider, case manager, family, and the contract holding agency must all be made aware, agree, and have written documentation to the fact. 

     

  • F: Legally Allowed to Work

  • ANGELS is contracting with the Contractor for services to be provided to a public entity. Incorporated into this Agreement is an Agreement to Comply Certification of Compliance with C.R..S. 8-17.5-101. el. seq., regarding the prohibition against knowingly employing or contracting with an unlawful alien to perform work under the Agreement, which must be signed as a condition of this Agreement, and regarding the parties' participation in the E-Verify program.

  • G: I will be honest and keep my client's confidentiality

  •     
            · Fraud 

    We all commit to being honest in our billing and descriptions of what we do in order to respect the service definitions and what our clients have been given in their service plan. If an error is made then a correction report will be filed as soon as possible for the errors can be correced. 
                 

    The Office of the Inspector General (OIG) say is fraud.

     

    1. Services Not Rendered: ANGELS cannot bill for services not actually rendered. Billing for services not actually rendered involves submitting a claim that represents the provider performed a service that all or part of which was simply not performed at the time stated.

     

    2 Medically Unnecessary Services: ANGELS cannot bill for medically unnecessary services. Billing for medically unnecessary services involves knowingly seeking reimbursement for a service that is not warranted by the client's current and documented medical condition.

     

    3 Duplicate Billing: Duplicate billing occurs when the home health agency submits more than one claim for the same service; bills for multiple services at the same time; or a bill is submitted to more than one primary payer at the same time. ***Sone services are specifically designed to allow assistance during medical appointments such as mentorship and personal care.

     

    4 Unqualified Personnel: ANGELS cannot bill for services for which the provider is unqualified or unlicensed to perform If a license or qualification lapses; then alternate, licensed personnel must perform the visit

     

    5 Misapplying Funds Providers and clients shall not steal, embezzle or otherwise convert to the benefit of another person, or intentionally misapply any funds, money, premiums, credits or other assets of a provider of any healthcare benefit program; including Medicare, Medicaid or a private payer.

     

    If a anyone client or provider, is found to be engaging in fraudulent documentation; ANGELS will report such actions to the proper authorities,  seek financial restitution and reserves the right to discipline the employee up to termination, contract remediation or termination, and/or discharge a client


                    · Pay all associate fees, including but not limited to fines, court costs, etc.
                 

                             
            · Over Payment

    In case ANGELS give you more money than you should have received (calculation error, error in notes, accidental or intential fruad, data entry error, etc.) then ANGELS is may take it back. 

    Refunding of Payments ANGELS shall promptly refund any payments made by state or federal agencies or private payers which were made erroneously and of which ANGELS was aware. If a collaborator realizes or discovers that documentation was submitted with incorrect information that may result in an overpayment, they must immediately notify ANGELS.

    BAA and HIPAA

    https://www.watchingfish.com/business-associate This is a link to the business associate agreement that all collaborators are bound by. It means you are personally responsible for safeguarding all client information and are responsible for the consequences if you compromise information.

    I understand that I am responsible for complying with the HIPAA policies and regulations.

    I Will treat all Information received, which relates to the patients of the provider, as confidential and privileged Information.

    I will not access patient information unless I have the need to know this information in order to perform my job.

    I will not disclose Information regarding the Provider's patients to any person or entity other than as necessary to perform my job, and as permitted under the HIPAA Policies.

    I Will not log on to any of the Provider's computer systems that currently exist or may exist in the future unless I am instructed to do so by the Privacy Officers.

    I Will not use e-mail to transmit consumer information unless I am instructed to do so by the ANGELS or client's have given permission in writing.

    I will not take patient Information from the premises of the Provider in paper or electronic form without first receiving permission from the ANGELS

    Upon separation from ANGELS, I agree to continue to maintain the confidentiality of any information I learned while associated with ANGELS, I agree to turn over any keys; access cards, or any other device that would provide access to the provider or Its information.

    · Please note, accessing confidentially information on a public Wi-Fi source is a violation of HIPPA

    I understand that violation of this agreement could result in my termination, effective immediately and a report to authorities.

                      

  • Collaborators shall permit access to sessions, or cooperate with request for information such as a phone call, meeting, or report, to ANGELS, the CCB, the State of Colorado Department of Human Services, the Colorado Department of Health Care Policy and Financing, the U.S. Department of Health and Human Services, and any other duly authorized agent or governmental agency including the Medicaid Fraud Control Unit. 

    Collaborators will help as needed to develop plans and support clients, families, and fellow workers. 

    We commit to follow any and all handbooks and verbal instructions provided detailing how services are performed.

  • H: Remedies and Termination

  • We want all of our community to have the chance for personal development. If there are any concerns we strongly look at the possibility of an action plan to support employees in growth and change before termination. 

    This may include mandated Plans of Correction required to be submitted to  ANGELS within 24 hours of a request.


    To align with client respect and to protect client well being in the event of:

    Termination of client specific service at client request agent IS NOT permitted to contact client further. Any needs will be directed towards agency. 


    Provider initiated termination with notice, statement may be shared with clients

    Termination of employment due to violation, agent IS NOT permitted to contact client further. Client's may initiate contact with provider.

  • I: Insurance

  •  

    Auto

    If you are driving clients you are required to have your car insured at 100/300 limits and have it inspected for safety. ANGELS pays for the inpsection. 

    All Colloborator Transportation Notes:

    · No one is to provide transportation services at any time for any reason for  individuals and families they serve outside of the service plan, if they so do so, they are in violation of this agreement and are responsible for all risk.

    · Transportation waiver: If transportation is taking place with a provider and a client due to dual relationships, a statement must be the client's digital file AND the provider's digital file, stating the dual relationship and that transportation is taking place outside of services and all liability is waived, including in the case of negligence.

    IN THE EVENT OF A WORK RELATED INJURY FOR EMPLOYEES OF ANGELS SERVICE ONLY

     

    You MUST alert ANGELS within 24 hours of an injury.

     

    In order to be sure you receive the care you need, we will file a claim with our worker's compensation insurance carrier; Pinnacol Assurance. Pinnacol will contact you with your claim number and additional information In the meantime, you should see one of the medical providers we have selected to treat our Injured employees. These medical providers specialize in on the-job injuries and we want you to have the best possible care.

     

    After your first appointment, please follow up with me so we can review your medical status and work capabilities. If an unauthorized medical provider treats an employee, the employee could be responsible for said treatment

  • J: Mandated Minimal Training

    We do annual training. However; if you prefer monthly review that is an option. It is designed to support ongoing education, address changes in rules and mandated reviews, provide assistance for commonly asked questions, a refresher for information, and disseminate information important to our loved ones both socially and from a health and safety perspective. Past topics have included things such as how to prevent family stressors, the importance of person first language, and how to take care of someone when they have the flu.
  • Position Purpose

  • Position Acknowledgment

  • Care Partnerships may be very diverse or specialize in limited scope. Example: you may be do a little of everything, or you may be assigned to a single specialty such as only homemaking or only massage. :) 

    • Providers will focus on the client’s development with attention to increasing a client’s / family’s ability to meet their developmental needs through life accessibility / person- centered support in the community and in-home intervention sessions, coaching, sharing ideas and consultation to facilitate life accessibility to enhance the client’s and family’s development in everyday routines. 
    • Providers will practice as a trans disciplinary team. Providers will look at how individuals learn; at home and in the community, in relationships and during every day routines/activities. 
    • Providers will acknowledge the expertise that clients and families have regarding their own lives. Providers will practice in working together on ideas and strategies that enhance daily functioning in everyday routines. 
    • Providers will support recipients of services to receive individualized, respectful care that is reflective of their own personal goals recorded in their service plan. 
    • Providers will only practice within their scope 
    • Providers may provide care across acuity levels and settings 
    • Providers will always leave the environment in the same or better condition as when they arrived. Better is preferred and expected depending on the service provided. 
    • Providers will accurately complete all paperwork in a timely fashion 
    • Providers will be timely to their sessions; if they are to be late or miss a session, they will contact Angels Service AND client. TIMELY FOR TIME SENSTIVE SESSION IS EARLY! 
    • Providers will request clarification for out-of-the-ordinary schedules. For example, if every day you get Angel off the bus at 3:30 but today your schedule says 3:40, provider will clarify that the change is accurate as this could indicate a human error. 
  • Position Duties

  • Essential Functions: 
    Work in a varied set of conditions 
    Will work in environments that are not necessarily ideal such as… dry, hot, wet, cluttered, dirty, loud, crowded, etc. Environments and duties may require stooping, crawling, climbing, balancing, etc.  
    ·        Lift 50 pounds on a regular basis 
    ·        Navigate the internet and read and understand written material 
    ·        Complete duties in a focused, efficient, and timely manner for the entire session  
    ·        Remain calm in stressful situations 
    Avoid phone use (both personal and with clients unless on a break or phone is part of the PLANNED purpose session; example a client has phone time for apps X,Y,Z or video modeling). 
    ·        Practice safety in all actions 
    ·        Attend training in person or online as required paid at minimum wage 
    ·        Complete online training and updates at prescribed schedule paid at minimum wage 
    ·        Respond to emergency requests outside of normally scheduled sessions. 
    Provide all data we would need to perform background checks, willingly divulge any actions that might be reflected on a background check outside of Colorado AND any events after hiring that results in a ticket or potential addition to a background check. 
    Use and care of adaptive equipment (glasses, eating equipment’s, lifts, gtubes, wheelchairs, etc.) with proper training

    3. Driving Record. We will ask you to supply your Motor Vehicle Record (MVR). No suspensions & less than three tickets in three years. 
    4. Smart phone with data to complete notes and skill set to navigate software

    Must be able to problem solve in the moment, follow instructions given in a variety of formats, and maintain a positive demeanor during and outside of work hours when representing Angels Service, interacting with the community, clients, or any and all other associates.

    Benefits and Compensation:

    ·        Hourly pay varies depending on skills, availability, duties, certifications, responsibilities, experience, and client needs. Piece rate may be offered. PAID EVERY OTHER WEEK.

    ·        85% of rate increases from our funding sources go directly to support employee’s

    ·       PTO (see handbook for details but starts with 32 hours of emergency time and 48 hours of sick and safe time that accures a little for each hour worked)

    ·        Employee Buy In Aflac Options for ALL Employees

    ·        Travel time calculated between clients and included in pay; unless piece rate has been established

    ·        Preapproved office time paid, but nearly all work is designed so there is only take home work on occasion

    ·        All supplies needed are provided by Angels Service. Just ask!

    Schedule:

    ·        As needed by clients, may include days, nights, weekends, or emergency calls. Notice must be provided when schedule is shifted; a session is started late or ended early and when a client no shows.

  • Job Duties

    • Developmental Care Partner Therapists will practice a family-centered approach to deliver supports and services to children and their families. Developmental therapist will complete assessments to determine developmental functioning of child and track growth. Developmental therapist will create and execute, a service plan in connection case managers and families. Will work towards meeting both growth towards developmental milestones and family centered goals based on a global outcome basis.  
      *Acknowledgment of required credentials: Licensed as an Early Childhood Special Education Specialist   
    • Massaging Care Partner Therapists will provide manual manipulation to soft tissue to facilitate comfort and relaxation and provide compassionate care for our clients. Providers will identify structural imbalances to gently shift towards a more ideal alignment to support quality of life and functionality. Providers will not use energy modalities, yoga, or other unauthorized modalities that do not include the manual manipulation of soft tissue provided directly by the therapist. Massage providers will commit to obtaining and maintaining experience and knowledge in overall development, disabilities, and the impact massage can have.  
      *Acknowledgment of required credentials: Licensed as Massage Therapist in the state of Colorado 
    • Hands-On Life Accessibility Facilitation Providers will provide hands-on personal care, which can range from stand-by support to full support in all activities of daily living such as, but not limited to, bathing, dressing, hygiene, and toileting.  
      *Acknowledgment of required credentials: Must have C.N.A. training OR agency training 
    • Life Accessibility Facilitation Providers will provide personal care including, but not limited to, helping with cooking/meal planning, technology assistance, employment, therapy and life planning practice, social and developmental skills, money management, shopping assistance, and prompting/cueing an individual to do something through a variety of means. Providers will assist with advocating, medical appointments and health management, and parenting skills. 
    • Community connection is a time to get involved in the community—to connect to the community. This can look different for each client and providers will adapt. Providers will support a variety of options; close to home, in the neighborhood, or exploration of the wider Colorado area. Providers will be prepared to plan, access resources, and support community connections that are from a few hours, all-day adventures, or extended overnight events. Providers will focus community connections on the core of the program being individuals to have purposeful interactions with their community and the other individuals who share it with them. Providers will always have a purpose when planning and supporting community connections and will respect the fact that recreation ONLY events are prohibited. 
      *Groups of ADULTS can do community connection together 
      *CHILDREN (17 and under) can only do community connections when it is a 1 to 1 ratio 
    • Homemaker duties include and are not limited to supporting a tidy, clean, and safe home. Providers will proudly work together to determine appropriate goals and level of homemaker services. Providers will adjust their service from tidying up and basic homemaking all the way to deeper cleaning based on diagnosis, such as bodily fluids, or advanced cleaning protocols. Providers might work indirectly with the client during homemaking services, focusing on the home only; or directly with the client with an instructional component where the client gets to learn some skills for homemaking. Providers will be respectful that homemaking duties may ONLY take part in areas of the home the client frequents. 
    • Providers will provide transportation to clients as needed and relevant to the best interest of the client and specific services. Transportation will include making sure clients safely access an approved vehicle with an approved driver and practice safe transport skills. Transportation may be provided directly by a provider or public transit may be facilitated by a provider.  
    • Providers will provide family system support (FSS). Family system support may be indirect by consulting with a team or lending expertise. FSS will be customized based on each family's needs. Providers may be paired with families that are single clients, a couple, a family with children, or adult children. Providers will support a variety of FSS needs. Providers will be trained in a variety of areas based on family system support needs, such as: topics related to the family system need with the goal of longevity in stability. A few areas of FSS include general well- being support ( a visit every 30 to 90 days for general support),  Sibling, Impact, Sibling Care, Child Massage, System/Life Navigation, Advocacy, Developmental Tutoring- What you can do!, Safe Home Access and Recreation Setup, How to Train Providers, How to Train Providers Coaching, Water and What to Know, Water Coaching, Self-Care, Self-Care Review, Extending Family Involvement & Coaching, Vacationing & Stay-cationing, Community, Here We Come! and Must Knows for When You're No Longer Here. OR anything that may support our family in immediate or longitudinal life success and comfort; this is our core. 
    • Though those with disabilities often experience discrimination, disability itself does not discriminate. Providers will practice Cultural competency consistently; providers will be accepting of where those around them are. Providers baseline will be meeting clients where they are. Providers will WAIT while clients are talking and sharing, they will observe and respond to the best of their abilities. When providers accidentally make an error of interaction with client; they will own it, apologize, and repair the relationship. Everyone makes errors, it is the choices afterwards that make a difference!
    • Providers will work with families to shape services in a cultural meaningful way; example; some families prefer to eat with fingers vs utensils or some families want a loud conversational dinner and others want a quiet dinner, specific attire *highly conservative clothing (religious or other preference based, no shoes, relaxed clothing so you can play and get dirty*. Providers will be respectful of cultural differences and how this shapes interactions, protocols, and desired outcomes. 
    • Care Partners will provide respite with a purpose. Respite is a time for primary caregivers to rejuvenate themselves while they rest assured that their loved one is receiving quality care from a professional care partner that is going to work to follow expectations. Respite is for clients to receive a well- rested care partner to participate in activities that may not otherwise be readily available to them day to day. Providers will understand that respite is not respite if the work is only delayed until the primary caregiver returns; therefore, providers will be invested that no tasks are left uncompleted during respite time. Providers will follow and—if and only if appropriate—expand established expectations. Expectations for respite include life routine-embedded activities that offer mental, sensory, and physical stimulation that have been selected by the family-professional team. Respite may include elements of other duties (see other duties listed in job description). 
    • Adaptability!!! We are here to facilitate life accessibility. We are here to serve our clients and each other. WHEN—not if—we need to step in, we will do so with grace. All providers will be adaptable and respond positively to unexpected tasks. Providers may be asked to complete tasks out of the ordinary or that do not fall neatly into a category above. For example: If a client’s grocery shopping care partner is ill, another provider close by might be called to cover the service, even if grocery shopping is not a duty they regularly perform. 
      Planning and adherence to plans! 
    • Providers will take part of planning when needed. This may be a part of a specific service; such as planning out a weeks worth of meals all the way to crisis response. At times providers may receive a completed care plan to follow or they may be a part of crafting a care plan either as part of a team or as the primary care plan writer.
    • Providers will be dedicated to following care plans both to the details the state has outlined in definitions and through case management along with details the family and we as a community have crafted. Needed changes or updates will be respectfully and in a timely fashioned be advocated for. 
    • Provider mentorship is an important part of what providers may be called on to do. Provider mentorship may include having someone shadow with you to learn the day to day tasks of the agency as a whole, the routines and needs of specific client(s) or sharing an area of your expertise.
