  • The proposed work has been reviewed by a representative of the Village of Somers Public Works Department. As provided by Section 86.07(2), Wisconsin Statutes, and Section 8.02 of the Village of Somers Ordinances, a permit therefore is granted, subject to the following conditions and any attachment or exhibit hereto:

    1. Proper barricades, signs, flags, lights, and flagmen shall be provided and maintained at all locations where construction and maintenance work interferes with normal traffic use of the highway. All markings and signing provided for traffic control purposes shall conform to the standards and specifications of the current isssue of the Wisconsin Manual of Traffic Control Devices, Part V.
    2. The applicant, his/her successors or assignees, agrees to hold harmless the Village of Somers and it's duly appointed agents and employees against any action for personal injury or property damage sustained by reason or exercise of the permit. 
    3. The proposed construction and the exercise of this permit shall conform to the requirements of the Wisconsin Statutes, and Section 8.02 of the Village of Somers Ordinances or to any regulations imposed by any legally constituted body having jurisdiction.
    4. The Village Public Works Departments reserves the right to make such changes, additions, and relocations with statutory limits on the right of way as may at any time be considered necessary to permit the relocation, reconstruction, widening, and maintaining of the highway, or to provide proper protection to life and property on the roadways. 
    5. The entire cost of construction, maintaing, removing, altering, or replacing the facility installed under this permit shall be the sole responsibility of the applicant, his successors or assigns, at the present time or any time in the future as may be directed by the Village of Somers or the Village of Somers Public Works Department.
    6. The roadway shall be kept open for traffic and/or emergency vehicles and the indicated number of lanes shall be provided. There shall be no interference with traffic, due to the placing of excavated material or machinery on the lanes kept open for traffic, unless authorized for closure by the Village Public Works Department.
    7. All dmages to the highway shall be repaired, and the roadway surface, shoulders, slopes, ditches ect. shall be restored to a condition acceptable to the Village of Somers and/or the Public Works Department at the sole cost and expense of the applicant. Any excavation within the shoulder of the road or the roadway pavement shall be filled using slurry and shall be inspected prior to paving by the Village Public Works Department. 
    8. Where the permitted work involves open trenching and/or tunneling, temporary sheeting and shoring shall be used as necessary to prevent soil caving, or under mining of adjacent pavement.
    9. A $5,000 Performance or Cash Bond shall be filled with the Clerk of the Village of Somers for each excavation.
    10. Applicants shall submit all necessary plans or plan/profiles depicting the project scope.
    11. Any changes or deviations from said plans shall requore the Applicant to resubmit revised plans for review from the permitting entity.
    12. A copy of this permit shall be retained by the permittee at the job site during construction.
    13. Kenosha Water Utility shall by sigining this permit, agree to a three (3) year Written Warranty against any settlement or defects in the road right-a-way on the norht nound lane for which this permit is being issued. The Kenosha Water Utility, who is intending to install a new watermain under this portion of 47th Avenue, shall confirm said warranty on Kenosha Water Utility letterhead and signed by the General Manager.
    14. The Kenosha Water Utility agrees to the attached restoration specifications in restoring the north bound lane of 47th Avenue, as recommended by the Village of Somers Engineer.

    The Somers Village Public Works Department shall have access to the work at all times for the purpose of inspection. The completed work, including highway restorations, shall be acceptable to the Village Administrator or his authorized representative.
