Please be on time for your session. I understand that sometimes there is traffic and that it can be challenging to get out the door for your newborn session. If you are running a couple minutes late, please send a text. If the session is done on location, the session time starts at the scheduled time and will end within 1 hour of scheduled appointment time.

Session fees are compensation for your Photographer’s time and talent. Session fees are due at the time of scheduling and must be received within 3 days, along with your electronic forms to hold your appointment slot. The agreed upon date/time for your session will be reserved, for this reason, the session fee is non-refundable. Without reasonable notice, you may forfeit your session fee. Misty Jones Photography reserves the exclusive right to reschedule due to weather conditions, including but not limited to rain, wind, hurricanes, extreme temperatures, etc. If conditions on that day are not desirable the client may ask for a reshoot prior to the session. If you do not request a reshoot, but later decide that you are unhappy with the images produced, due to weather conditions, a $100 reshoot fee will be charged.

Prior to your order all images will be given a “soft edit”, once the order is placed/paid images will get a more detailed edit. All retouching, cropping, and other artistic styles are at the sole discretion of the Photographer. Any additional requests for minor revisions will include a $10 charge per image. Any major revisions will be subcontracted out and will be subject to an additional fee. Fees on major revisions will vary depending on the request being made. Blinks and unflattering images decided by the photographer will not be shown and will be deleted. If you are unhappy with your proofs, we will be glad to do one re-shoot if requested within 7 days. Reshoot will not include hair and makeup. All images from the first session will be erased.

There will be 3 revisions allowed for items such as storyboards, cards, albums, etc… Please make sure you review the item(s) carefully before submitting any revisions. Any additional revisions will include a $10 charge per revision.

During the session there are to be no other recording devices.

Payment is due when the order is placed. We offer payment plans for those that are interested. No part of any order will be delivered, including previews, until the balance is paid in full. Due to the custom nature of prints, all items are non-returnable or refundable. If there are any problems with the quality of your prints, we must be notified within 24 hours of receipt. Your online ordering gallery will remain active for 4 days, should your gallery viewing time need to be extended, there is a $35 charge. Expect 4 weeks for prints to be delivered after your payment has been submitted and cleared. Albums can take up to 6 weeks. All returned checks are charged a returned check fee of $35. Prices are non-negotiable. Various specials are run throughout the year and it is your responsibility to notify photographer of any specials that you will be using prior to placing your order. Photographer will provide you with a code that you can use when purchasing your order to receive your special.

8.5% sales tax will be added to print orders as well as a $10.00 shipping fee (unless you are picking up your order). Prices at the time of your session will remain in effect for 30 days. Any reprint orders after this time will be subject to the most recent price list. All ORDERED images are kept on file for 1 year, files will be deleted after 1 year. Please note the information on www.MistyJonesPhotography.com is not always current due to limitations such as time constraints, server access and others. If there are discrepancies between what is on the website and what is listed here in the contract that the contract supercedes what is on the website.

Referrals: For every paid referral you will receive a $50 print credit to be used on your next order. After 5 referrals you will receive a complimentary session fee. Please make sure you ask for your print credit code before placing your order.

Yearly Client Loyalty Program (takes place after your 1st session): 2nd session - receive a print credit for $50. 3rd session - receive a print credit for $100. 4th session - receive a print credit for $150. 5th+ session - receive a complimentary session fee. Complimentary session does not include any print credits and must be booked within the current calendar year, please ask for print credit prior to placing order.

Misty Jones Photography retains the ownership of every image resulting from your portrait session. You may purchase the prints or digital copies of these images, but the Photographer retains copyright ownership over the image. This means that downloading, scanning, altering, printing or copying any of these images, in any way, without the explicit written permission of your Photographer is illegal under federal copyright law. Regarding the images delivered, as digital files or otherwise, client’s rights are limited to personal use. Photographs may not be sold or used in advertising unless otherwise specified by the Photographer. Client hereby agrees to indemnify, release, discharge and hold harmless the Photographer, its heirs, legal representatives, assigns, employees or any persons or corporations acting under permission or authority of the Photographer from and against any liability or claims arising as a result of any work done related to this agreement. This includes, but is not limited to claims related to the use of the likenesses of anyone captured in the images or any distortion, blurring or alteration that may occur or be produced in the taking, processing or reproduction of the photographs. Although all care will be taken with these photography services and the digital photographs taken, the Photographer limits any liability for loss, injury, death, inability to perform the photography services for any reason, failure to deliver images for any reason or any other types of damages to the return of all payments already paid to the Photographer up to total amount paid for session. Florida state laws, shall govern, construe, and enforce all of the rights and duties of the parties. All claims and disputes arising under or relating to this agreement are to be settled by binding arbitration in the state of Florida. I have read and understand the policies of Misty Jones Photography.

CONTRACT: I certify that I am at least 18 years of age. I agree that I have the legal authority to grant these permissions and I accept responsibility for such. I have read and understand the policies of Misty Jones Photography.

MODEL RELEASE: I hereby consent to and authorize the use and reproduction, in print and electronic format by Misty Jones Photography or anyone authorized by Misty Jones Photography, the irrevocable and unrestricted right to use and publish any and all photographs of me and/or my children for any publicity purpose, without compensation, or in which I may be included, for editorial, trade, advertising, and any other purpose and in any manner and medium; to alter the same without restriction, and to copyright the same. I hereby release Misty Jones Photography and his/her legal representatives and assigns from all claims and liability relating too said photographs.

I/We, names of people being photographed , knowingly and willingly consent to being photographed with Misty Jones Photography. I/We understand that the COVID-19 virus has a long incubation period, which carriers of the virus may not show any symptoms, and still be contagious. I/We understand that MJ, photographer at Misty Jones Photography, will take all precautions suggested with COVID-19 prevention. I/We release Misty Jones Photography from any liability associated with receiving a COVID-19 positive diagnosis following our session.
       initials   I/We understand that should I/We test positive for COVID-19 within 14 days following my session with Misty Jones Photography, that I/We will contact Misty Jones Photography to let them know of my positive diagnosis.
  I/We confirm that I am not presenting any of the following symptoms of COVID-19; fever, shortness of breath, cough, runny nose, sore throat, vomiting, or diarrhea.  Should I/We present with any of these symptoms, 14 days prior to my scheduled session, I/We will contact Misty Jones Photography to reschedule.

I/We also understand that I/We will be asked to remove my/our shoes at the door and that I/We will bring along any shoes for the session in a separate bag.
