• Independent Contractor Agreement between Fitness Instructor & Bring the Gym to Me

  • Please read through each of these points carefully and make sure that you understand each one. If you have any questions or concerns, please call (347)915-5496 or email info@bringthegymtome.com:

     

    • Payment/salary information may not be shared with clients nor with any instructors who currently work for or have worked for Bring the Gym to Me. Any questions or concerns about payment should be discussed with Sarede or anyone else from BGM's administrative staff.

     

    • Payments should never be accepted directly from the client. If the client offers to pay you directly, kindly decline and explain that the payment should be made through the BGM administrative staff. 

     

    • Tips are not necessary or expected but if they are offered you are welcome to accept.

     

    • You may not share your contact information with the client or ask for the client's contact information (i.e. phone number/email address/facebook account etc)

     

    • If the client asked for any info to be shared with them (such as articles/resources or links to exercises they can practice at home, or if you wish to share these things of your own accord, tell her/him that you will send to the BGM administrative staff and we will forward it to them. 

     

    • If you need to reschedule or cancel a class, are running late, or have showed up to an appointment and the client is not there, you must call (347)915-5496 or email info@bringthegymtome.com to discuss.

     

    • Any issues/questions/feedback you have about the client and class style should be discussed with the BGM administrative staff  and only discussed with the client upon my approval.

     

    • You may not be hired by the client or by anyone the client refers you to on your own for any sessions whether they are to take place in the same or different facility as your usual sessions.

     

    • If the client offers to hire you or refers you to someone else or someone else wishes to hire you as a result of having heard about/met you through the client, you must tell them that they need to contact the BGM administrative staff at (347)915-5496 or email info@bringthegymtome.com to schedule sessions.

     

    • There is a 24 hour cancelation/rescheduling policy. If you cancel or reschedule your session within 24 hours of the scheduled appointment, you will be obligated to find a replacement instructor. (Exceptions due to extenuating circumstances such as life threatening medical conditions, accidents or severe weather conditions may apply on a case by case basis). If you are unable to find a replacement for yourself, you will be obligated to give a makeup session for no pay to you as a form of compensation/penalty. 
    • Addendum: We allow a one time one hour grace period for this policy.  So as long as we receive your cancelation within 23 hours, you will not be obligated to give a free makeup session if this is the first time you have done so.

     

    • Note, clients are also subject to a 24 hour cancelation/rescheduling policy. If ever a client cancels a session with you less than 24 hours in advance, you will still be compensated for that session.
    • Addendum: We allow a one time one hour grace period for this policy. So as long as we receive the cancelation within 23 hours, we will not charge the client, so long as this is their first time doing so.  
    • Addendum: If the client wishes to have the cancelation fee waived, they may set up another class for the instructor at the same time with another client (i.e a friend or a relative). The instructor will only be obligated to teach this class in lieu of the original class if it the same style and similar distance for the instructor to get to (up to 10 minutes further). The client should not make a habit of doing this however and if this occurs too often, Bring the Gym to Me has the right to revoke this policy. 

     

    • We allow a 1 hour grace period for all class reservations made. So if we confirm you to teach a class but then cancel within 1 hour (even if it's within 24 hours of the scheduled time), you will not be compsensated for the class.   

     

    • Bring the Gym to Me hours of operation are 8:00 am-9pm. All cancelations or requests for reschedule must be made during that time.

     

    • You are expected to arrive at least 5 minutes early to each appointment.

     

    • Any tardiness that is reported to the BGM administrative staff will be noted and if it happens enough times, then there may be consequences such as pay deduction, reduction in new client relationships (i.e. job offers) or if the problem is consistent enough, possible termination.

     

    • If you are between 15-30 min late to a session, ½ of your pay for that session will be deducted as a form of compensation/penalty.

     

    • If you are 30 or more minutes late or do not show up to your scheduled appointment for whatever reason, you will not be paid for the session and will be obligated to give a makeup session free of charge (no pay to you).

     

    • For a period of 3 months following the termination of this Agreement, whether such termination is voluntary or involuntary,  you may not solicit any customer of Bring the Gym to Me for your own business or for the benefit of a third party that is engaged in such business. 

     

    • If any breach is made to any of the above terms and conditions, the relationship between the instructor, client and Bring the Gym to Me will be subject to termination and legal action may be pursued.

     

  • COVID-19 Addendum

  • This is also to certify that Bring the Gym will not be held liable for any illnesses or infection as a result of Covid-19, and I have the responsibility to inform Bring the Gym to Me of any illnesses and postpone or cancel sessions beforehand if I have a fever and/or am not feeling well.
